Town of Mashpee <br /> w� wr 16 Great Neck Road North <br /> f Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2024-35 <br /> Owner, Barbara Paciello Bk.: 35896 <br /> 87 Lighthouse Lane Pg.: 306 <br /> Map 90 Parcel 48 <br /> Mashpee, MA 02649 <br /> A Petition was filed on July 2, 2024 by Owner, Barbara Paciello requesting a Written Finding <br /> under §174-17 and §174-33 of the Zoning Bylaws to allow for construction of a farmers porch <br /> addition, extension to a pre-existing, nonconforming structure on property located in an R-3 <br /> Zoning District,at 87 Lighthouse Lane, Map 90, Parcel 48, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on July 5, 2024 and July 12, 2024 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,July 24,2024 <br /> at which time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman,Ronald Bonvie,Board Members,Sharon Sangeleer,Jonathan Furbush, Scott Goldstein, <br /> and Associate Member, Charles Reidy. Also present was David Morris, Building Commissioner. <br /> Mr. William Lockwood,with Lockwood Architects represented the homeowner who is requesting <br /> a Written Finding under §§174-17 and 174-33 for a farmer's porch addition. The project was <br /> approved by the Conservation Commission and received an RDA. The house is pre-existing, <br /> nonconforming. <br /> The site plans depicts the existing structure being setback 33.8 ft. from the lot line situated along <br /> Jackbon Road, and setback 38.3 ft. from the lot line to Lighthouse Lane, which is considered <br /> nonconforming. The non-wetland portion of the lot consists of 14,524 sq.ft.at 11.1%lot coverage, <br /> and the proposed structure coverage will increase to 12.9%,but is still under the 20%requirement. <br /> Mr. Lockwood said that the existing structure is setback 75 ft. from the top of the coastal bank, <br /> and slopes toward the dock in the rear. The deck of the existing building is 59.5 ft. to the water. <br /> 1 <br />
