MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT MODIFICATION <br /> Petitioner, David Hirsch, E. J. Prescott, Inc. (EJP) <br /> Owner of Record: PMP Realty LLC <br /> 14 Wags Road, Map 81, Parcel 6 <br /> Mashpee,MA 02649 <br /> SP-2024-34 <br /> GENERAL FINDINGS <br /> The Conservation Department comments dated July 17, 2024 were read into the record; "No <br /> comment". <br /> The Board of Health Comments dated July 23, 2024 were read into the record; "Wholesale only". <br /> The Board is familiar with the building and agreed it is well maintained,and has a sprinkler system. <br /> Mr. George Boiros, an abutter who resides at Deer Crossing Condominiums and is on the <br /> Association Board of Trustees addressed the Board. He said that Wags Road is a gated road and <br /> is primarily used for emergencies by the Fire Department. He also mentioned that there are issues <br /> with tractor trailer trucks blocking the road to the condo complex. He wanted to know if the <br /> applicants will be changing the road layout. He does not want the road to be used as a through <br /> way. <br /> Chairman Bonvie suggested that the applicant has a discussion with Mr. Boiros regarding any <br /> concerns. <br /> Mr. Hirsch said that the road and gate will remain as it is today. <br /> Mr. Goldstein mentioned as one member that this business is very reputable and keeps their facility <br /> clean. Mr. Goldstein suggested that they have a discussion with the Fire Department. <br /> SPECIAL PERMIT CRITERIA <br /> Section 174-24 (C) 2 —A Special Permit may be issued only following the procedures specified <br /> by the General Laws and may be approved only if it is determined that the proposed use or <br /> development is consistent with applicable state and town regulations, statutes, bylaws and plans, <br /> will not adversely affect public health or safety, will not cause excessive demand on community <br /> facilities,will not significantly decrease surface or groundwater quality or air quality,will not have <br /> a significant adverse impact on wildlife habitat, estuarine systems, traffic flow, traffic safety, <br /> waterways, fisheries, public lands or neighboring properties, will not cause excessive levels of <br /> noise, vibrations, electrical disturbance, radioactivity or glare, will not destroy or disrupt any <br /> species listed as rare, endangered or threatened by the Massachusetts Natural Heritage Program or <br /> 2 <br />
