MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT MODIFICATION <br /> Petitioner,David Hirsch, E. J. Prescott, Inc. (EJP) <br /> Owner of Record: PMP Realty LLC <br /> 14 Wags Road, Map 81, Parcel 6 <br /> Mashpee, MA 02649 <br /> SP-2024-34 <br /> any known historic or archaeologic site, will not produce amounts of trash, refuse or debris in <br /> excess of the town's landfill and waste disposal capacities, will properly dispose of stumps, <br /> construction debris,hazardous materials and other waste,will provide adequate off-street parking, <br /> will not cause excessive erosion or cause increased runoff onto neighboring properties or into any <br /> natural river, stream,pond or water body and will not otherwise be detrimental to the town or the <br /> area. <br /> SPECIFIC FINDINGS <br /> In view of the foregoing, the Board determined the Petitioner met the criteria for a Modification <br /> to the existing Special Permits. Upon motion duly made and seconded at the Public Hearings on <br /> Wednesday,July 24,2024 the Zoning Board of Appeals voted unanimously to issue a Modification <br /> to Petitioner, David Hirsch, with E.J. Prescott, Inc. (EJP) under §174-24 (C) (2), §174-25 (G) (6) <br /> of the Zoning Bylaws, and the existing Special Permit(s), (SP-2020-56), (SP-04-26) for a change <br /> of use to wholesale sales with indoor and outdoor storage of water works materials on property <br /> located in the I-1, C-1, and R3 Zoning District(s), at 14 Wags Road, Map 81, Parcel 6, Mashpee, <br /> MA. (Owner of Record: PMP Realty LLC)with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> Modification under M.G.L. Section 9. <br /> 2. Original Site Plan—Prepared by BSS Design dated January 29, 2004. <br /> 3. Conditioned on all Town Department comments read into the record including but not <br /> limited to the Board of Health comments that the use be wholesale only. <br /> 4. Any changes to the plan will require the applicant to return to this Board. <br /> 5. The Board finds that the Modification is consistent with the use under §174-24 (C) (2), <br /> §174-25 (G) (6) of the Zoning Bylaws and the existing Special Permit(s), (SP-2020-56), <br /> (SP-04-26). <br /> 3 <br />
