Mashpee, MA 02649 <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2024-32 <br /> Owner, Mary Jane Colton, Trustee of the Doc.: 1343647 <br /> 93 Bluff Avenue Realty Trust Ctf.: 215839 <br /> 93 Bluff Avenue <br /> Map 118, Parcel 57 <br /> Mashpee, MA 02649 <br /> A Petition was filed on June 3,2024 by Owner,Mary Jane Colton,Trustee of the 93 Bluff Avenue <br /> Realty Trust requesting a Written Finding under §174-17 and §174-33 of the Zoning Bylaws to <br /> allow for construction of a roof over the existing deck, reconfigure the access stairs to deck, and <br /> add a new front entry way to a pre-existing,nonconforming dwelling on property located in an R3 <br /> Zoning District and the Popponesset Overlay District, at 93 Bluff Avenue, Map 118 Parcel 57, <br /> Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on June 14, 2024 and June 21,2024 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday,July 10,2024 <br /> at which time the following members of the Board of Appeals were present and acting throughout; <br /> Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, Jonathan <br /> Furbush, and Scott Goldstein. <br /> Attorney Christopher Kirrane represented the homeowners requesting a Written Finding under <br /> §174-17 and §174-33 for three alterations to the existing structure. The site plan provided by Cape <br /> & Islands Engineering highlighted the area depicting an overhang over an existing deck, <br /> reconfiguration of existing access stairs, and adding a front entry way, all within the 50 ft. seback <br /> to wetlands. <br /> The home is situated on a 10,565 square foot lot with 110 feet of frontage on Bluff Avenue in the <br /> Popponesset Overlay District, and is totally in Land Subject to Coastal Storm Flowage which <br /> makes the lot non-conforming at 100% lot coverage, and setbacks to wetlands is zero. There are <br /> no new non-conformities being created. The stairs are not encroaching on any setbacks. The actual <br /> structure coverage is 15.9%, and is well under the 25%requirement. <br /> 1 <br />
