MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owner, Mary Jane Colton, Trustee of the <br /> 93 Bluff Avenue Realty Trust <br /> 93 Bluff Avenue, Map 118, Parcel 57 <br /> Mashpee, MA 02649 <br /> FINDING-2024-32 <br /> GENERAL FINDINGS <br /> The subject property located at 93 Bluff Avenue has 10,565 square feet of land. The minimum <br /> dimensional requirements in the Popponesset Overlay District are as follows: <br /> Minimum Lot Size—6,000 square feet <br /> Minimum Frontage—60 feet <br /> Minimum Front Yard Setback—25 feet <br /> Minimum Side and Rear Yard Setbacks— 15 feet <br /> The Conservation Comments dated July 8, 2024 were read into the record "Resource Areas: Land <br /> Subject to Coastal Storm Flowage (LSCSF), buffer zone to Coastal Dune, and buffer zone to <br /> Coastal Beach. Administrative Approval was issued due to construction of roof over existing deck <br /> will require no new footings, replacement of existing deck on existing footings with no expansion, <br /> relocation of front door, and reduction in width of side deck access steps. " <br /> The Board of Health comments dated July 8, 2024 were read into the record. "House is in Zone II, <br /> the floor plans shows 3 bedrooms. If they are removing a bedroom from 4 to 3 the 4rh bedroom <br /> cannot be put back in in the future because it is in a Zone II and only 10,000 Sq. Ft. of property. <br /> Otherwise no Comment. " <br /> The Board had no issues with the proposed project. There were no abutters present. <br /> WRITTEN FINDING CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or uses may be <br /> continued, although not conforming with the provisions of this chapter. Non-conforming single- <br /> or two-family dwelling structures may be changed, extended or altered if such change, extension <br /> or alteration complies with the dimensional requirements applicable to the lot under current <br /> provisions of§174-31 or,for lots which have been developed pursuant to §174-21,complies with <br /> such requirements as were applicable to initial construction of the dwelling under provisions of <br /> §174-21. <br /> Changes, extensions or alterations of non-conforming single- or two-family dwelling structures <br /> which do not meet the applicable dimensional requirements as set forth above, and changes, <br /> extensions or alterations of all other non-conforming structures, or non-conforming uses, may <br /> not be made unless there is a Written Finding by the Zoning Board of Appeals that such change, <br /> extension or alteration shall: <br /> 2 <br />
