Barry Doc.: 1411163 <br /> Trustee of the K& M Realty Trust Ctf.: 224325 <br /> 3 Pinecrest Avenue <br /> Map 49 Parcel 168 <br /> Mashpee, MA 02649 <br /> A Petition was filed on July 19, 2024 by Petitioner, Michael S. Cannata requesting a Written <br /> Finding under §174-17 of the Zoning Bylaws to allow for construction of a three-season room <br /> above a pre-existing, nonconforming attached garage on property located in an R-5 Zoning <br /> District, Map 49, Parcel 168, Mashpee, MA. (Owner of Record: Lorraine E. Barry,Trustee of the <br /> K & M Realty Trust). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on July 26, 2024 and August 2, 2024 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, August 14, <br /> 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ronald Bonvie, Board Members, Sharon William A. Blaisdell, Jonathan <br /> Furbush, Scott Goldstein and Associate Member, George Ganzenmuller. <br /> Mr. Michael Cannata, Building and Remodeling represented the homeowners for the Written <br /> Finding request under §174-17 to add a three-season room above an existing garage. The garage <br /> has a flat rubber roof and has been problematic for several years, and the homeowners would like <br /> to repair it, and add living space. There will be no heat or potable water within the proposed space, <br /> and no work encroaching on any setbacks. The existing dwelling is located on a corner lot, and a <br /> Variance was granted by the Board for the garage in 1988. <br /> The Building Commissioner referred this project to the Zoning Board because of the Variance that <br /> was issued back in 1988. The Board reviewed the as-built/site plan that depicted the existing <br /> dwelling, deck, and garage and determined the garage is a pre-existing, nonconforming condition <br /> under §174-17 of the Zoning Bylaws. <br /> 1 <br />
