Cayer and Bk.: 35995 <br /> Allison E. Cayer pg.: 255 <br /> 71 Hooppole Road <br /> Map 57 Parcel 45 <br /> Mashpee, MA 02649 <br /> A Petition was filed on July 19, 2024 by Petitioner, Strong Tree Engineering LLC requesting a <br /> Special Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze a pre-existing, <br /> nonconforming structure,and replace it with a new single-family structure and accessory dwelling <br /> unit (ADU) on property located in an R-5 Zoning District, at 71 Hooppole Road, Map 57, Parcel <br /> 45,Mashpee, MA. (Owners of Record: Steven K. Cayer and Allison E. Cayer). <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, July 26, 2024 and August 2, 2024 a copy of which is attached hereto and <br /> made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, August 28, <br /> 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, <br /> Jonathan Furbush, and Associate Member, Charles Reidy. Also present was David Morris, <br /> Building Commissioner. <br /> Mr. Steven Cayer represented his raze and replace project under §174-17.1 of the Zoning Bylaws <br /> located at 71 Hooppole Road. Mr. Cayer received approval from the Conservation Commission. <br /> The project includes a new four bedroom home that will comply with all setbacks and height <br /> restrictions, and a new septic system. The site also includes a 900 sq. ft. Accessory Dwelling Unit <br /> (ADU) that will comply with all zoning requirements, and will be connected to the septic system. <br /> The existing dwelling to be razed does not meet the current zoning setback requirements to a <br /> water/wetland under §174-33 located in the R-5 Zoning District. <br /> I <br />
