MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Steven K. Cayer and Allison E. Cayer <br /> 71 Hooppole Road, Map 57 Parcel 45 <br /> Mashpee, MA 02649 <br /> SP-2024-40 <br /> SPECIAL PERMIT FINDINGS <br /> The subject property located at 71 Hooppole Road contains a total of 5.2 acres of land. <br /> The subject lot is located within the R-5 Zoning District and requires the following minimum <br /> dimensional requirements: <br /> Minimum Lot Size— 80,000 square feet <br /> Minimum Frontage— 150 feet <br /> Minimum Front Yard Setback—40 feet <br /> Minimum Side and Rear Yard Setbacks— 15 feet <br /> Maximum Lot Coverage—20% <br /> The Conservation Department comments dated August 27, 2024 were read into the record; <br /> "Resource Areas: Buffer zone to Inland Bank & buffer zone to Bordering Vegetated Wetland <br /> (BVW). Notice of Intent (NOI) application was approved unanimously due to benefits the project <br /> will have to resource areas and buffer zones onsite. With NOI approval a condition to reduce lawn <br /> between the pond and the cottage, in the buffer zones, and plant with native vegetation. " <br /> The Board of Health comments dated August 27, 2024 were read into the record; "6 bedroom <br /> property, 4 bedrooms in Main House and 2 bedrooms in ADUat top ofproperty. Original house <br /> to be disconnected from septic. <br /> There were no abutters present. <br /> The Board made the following findings: <br /> • The proposed structure was approved by the Conservation Commission. <br /> • There are no new non-conformities being created. <br /> • The tennis court will remain. <br /> • The 900 sq. ft. (ADU)Accessory Dwelling Unit is allowed, but the basement and <br /> attic is to remain non-habitable space, i.e., no heat. <br /> • Construction of the dwelling is contingent upon Board of Health final approval. <br /> • Construction of the dwelling will conform to current building code requirements. <br /> SPECIAL PERMIT CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses <br /> §174-17.1 Raze and Replace History:Added 10-15-2018 ATM,Article 16,approved by Attorney <br /> General 1-9-2019. <br /> 2 <br />
