MASHPEE "ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Steven K. Cayer and Allison E. Cayer <br /> 71 Hooppole Road, Map 57 Parcel 45 <br /> Mashpee, MA 02649 <br /> SP-2024-40 <br /> No pre-existing, non-conforming single or two (2) family dwelling structures shall be torn down <br /> and rebuilt on any lot unless there is an issuance of a Special Permit from the Zoning Board of <br /> Appeals. Such a Special Permit may be granted only if the Zoning Board of Appeals finds that <br /> any changes, extensions, alterations or reconstruction of the pre-existing non-conformities are <br /> not substantially more detrimental than exists prior to removal of the existing structure and that <br /> there is adequate land area to provide sufficient parking. In no case shall new non-conformities <br /> be permitted without the issuance of a Variance. <br /> §174-33 — Setback from water and wetlands: Any building or structure, exclusive of fixed or <br /> floating piers, wharves, docks, bridges or boardwalks, shall be set back at least (50') feet from <br /> any water or wetland as defined by MGL C. 131, §40. <br /> SPECIAL PERMIT CONDITIONS <br /> Upon motion duly made and seconded at the Public Hearings on Wednesday, August 28, 2024, <br /> the Zoning Board of Appeals voted unanimously to issue a Special Permit to Owners, Steven K. <br /> Cayer and Allison E. Cayer under §174-17.1 and §174-33 of the Zoning Bylaws to raze a pre- <br /> existing,nonconforming structure, and replace it with a new single-family structure and accessory <br /> dwelling unit(ADU) on property located in an R-5 Zoning District, Map 57, Parcel 45, Mashpee, <br /> MA with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a Special Permit <br /> under Mass General Law 40A Section 9. <br /> 2. Site Plan— Project: Site Improvements, 71 Hooppole Road, Mashpee, MA. Prepared for: <br /> Steven Cayer. Date: 04/24/2024. Revisions: 5/23/24, Revised Buffer Zones for <br /> Conservation, 6/7/24, Proposed Coverage Added for ZBA, 8/22/24, Proposed House & <br /> Septic Shifted Further North (Away From Pond). Prepared by Strong Tree Engineering, <br /> Stamped and signed by Justin J. Lamoureux, Registered Civil Engineer: No. 47377. <br /> 3.
