Rutana, Trustees <br /> requesting a Special Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze a pre- <br /> existing, nonconforming structure, and replace it with a new single-family structure on property <br /> located in in the R-3 and Popponesset Overlay Zoning Districts, at 53 Greenwood Road,Map 117, <br /> Parcel 343, Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise, a newspaper of general circulation in <br /> the Town of Mashpee, on August 9,2024 and August 16, 2024 a copy of which is attached hereto <br /> and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §9 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, August 28, <br /> 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ronald Bonvie, Board Members, Sharon Sangeleer, William A. Blaisdell, <br /> Jonathan Furbush, and Associate Member, Robert Caggiano. Also present was David Morris, <br /> Building Commissioner. <br /> Attorney Christopher Kirrane represented the homeowners located at 53 Greenwood Road <br /> requesting a Special Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze a pre- <br /> existing,nonconforming structure,and replace it with a new single-family structure. This property <br /> is located in the Popponesset Overlay District and has specific dimensional requirements. <br /> There are several non-conformities on this lot. The lot is only 821 sq. ft. for zoning purposes due <br /> to the presence of flood zone and subject to coastal storm flowage. It does not meet the 50 ft. <br /> setback to wetlands. <br /> 1 <br />
