MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A SPECIAL PERMIT <br /> Owners, Brian and Elizabeth L. Rutana, Co-Trustees of the <br /> Brian and Elizabeth Rutana Trust <br /> 53 Greenwood Road, Map 117, Parcel 343 <br /> Mashpee, MA 02649 <br /> SP-2024-44 <br /> There is 100% lot coverage because 99% of the lot is located in the flood zone. The front yard <br /> setback to Shore Drive is nonconforming at 24.4 ft. The rear yard setback to Shore Drive is <br /> nonconforming at 3.5 ft. The rear yard setback to Greenwood Road is nonconforming at 1.7 ft. <br /> The raze and replace of the dwelling on this property will improve considerably. The lot coverage <br /> is reduced from 32.3% to 22.8%. The current total percentage of lot area is 32.3% which is a <br /> nonconforming condition under the old calculations.The overall structure is decreasing from 2,103 <br /> sq. ft. to 1,482 sq. ft. The front yard setback will become conforming at 25.5 ft. The rear yard <br /> setbacks from Shore Drive and Greenwood Road are also being eliminated and will become <br /> conforming at 15.5 ft. The house will be flood zone compliant and building code compliant. A <br /> new I/A septic system is proposed, and dry wells will be installed. This project has been approved <br /> by the Conservation Commission. There are no new nonconformities being created. There is no <br /> increase in bedroom count, and the new dwelling is consistent with the redevelopment in the <br /> neighborhood. <br /> SPECIAL PERMIT FINDINGS <br /> The Board of Health comments dated August 27, 2024 were read into the record; "2 bedroom <br /> house with an IIA septic in Zone II. Future increase in bedrooms will not be allowed without <br /> nitrogen credit land. " <br /> The Conservation Department comments dated August 27, 2024 were read into the record; <br /> "Resource Area:LSCSF. NOI application was approved unanimously due to improvements to the <br /> property through an Ll septic system upgrade,flood compliant foundation, drywell installation, <br /> and pervious driveway install with conditions to connect drain pipe into abutters property into <br /> drywells, all lawn on property is comprised of a micro-clover variety, and adhere to Regulation <br /> 31: Nitrogen-Loading/Lawn Standards. " <br /> Attorney Kirrane confirmed that the drain pipes are being connected into the drywells. <br /> Mr. Mark Dibb with Cape & Islands Engineering stated that the storm water drainage is designed <br /> for a 25-year event. <br /> There were no more comments from the Board. <br /> 2 <br />
