� ys�fl� Town of Mashpee <br /> 16 Great Neck Road North <br /> ' Mashpee, MA 02649 <br /> u , <br /> ". ra `Po <br /> MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> FINDING-2024-49 <br /> Owners, Craig Jordan Chaffee and Doc.: 1421173 <br /> Marybeth Chaffee Ctf.: 225457 <br /> 11 Waterline Drive North <br /> Map 120, Parcel 170 <br /> Mashpee, MA 02649 <br /> A Petition was filed on August 29,2024 by Owners, Craig Jordan Chaffee and Marybeth Chaffee <br /> requesting a Written Finding under §174-17 and §174-33 of the Zoning Bylaws to allow for <br /> removal of an existing deck to be replaced with a new front porch, and a new second floor addition <br /> to a pre-existing, nonconforming structure on property located in an R-3 and Little Neck Bay <br /> Cluster Subdivision, at 11 Waterline Drive North, Map 120,Parcel 170,Mashpee, MA. <br /> Notice was duly given to abutters in accordance with Massachusetts General Laws Chapter 40A. <br /> Notice was given by publication in The Mashpee Enterprise,a newspaper of general circulation in <br /> the Town of Mashpee, on September 6, 2024 and September 13, 2024 a copy of which is attached <br /> hereto and made a part hereof. <br /> The Mashpee Zoning Board of Appeals issues this Decision pursuant to the provisions of <br /> Massachusetts General Laws Chapter 40A §6 and the Town of Mashpee Zoning By-laws. <br /> Public Hearings were held on the Petition at the Mashpee Town Hall on Wednesday, September <br /> 25, 2024 at which time the following members of the Board of Appeals were present and acting <br /> throughout; Chairman, Ronald Bonvie, Vice Chair, Sharon Sangeleer, and Associate Members, <br /> Charles Reidy, Robert Caggiano and Michael Milbury. Also present was David Morris, Building <br /> Commissioner. <br /> Attorney Kevin Klauer represented the homeowners requesting a Written Finding under §174-17 <br /> and §174-33 of the Zoning Bylaws. Also present was Mark Dibb, with Cape & Islands <br /> Engineering, and a representative from HPA Architects. <br /> The application consists of removing an existing deck and replace it with a new front porch, and a <br /> new second floor to include a balcony above an existing deck. The lot is 15,371 sq. ft. in the R-3 <br /> Zoning District and the Little Neck Bay Cluster Subdivision. The dwelling is pre-existing, <br /> nonconforming from lot coverage, rear and side yard setbacks, and the 50 ft. setback from <br /> wetlands. The lot is totally within Land Subject to Coastal Storm Flowage (LSTCSF) in <br /> accordance with the regulations under §174-31 footnote (fn.) 16 in the Zoning Bylaws. <br /> 1 <br />
