MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owners, Craig Jordan Chaffee and Marybeth Chaffee <br /> 11 Waterline Drive North, Map 120, Parcel 170 <br /> Mashpee, MA 02649 <br /> FINDING-2024-49 <br /> The pre-existing,nonconforming front yard setback on the site plan depicts 34.7 ft.from Waterline <br /> Dr. North, and 26.7 ft. from Wheelhouse Lane where 30 ft. is required. The pre-existing, <br /> nonconforming rear yard setback is 16.4 ft. where 20 ft. is required, and the side yard setbacks are <br /> 10 ft. where 15 ft. is required. The proposed project will not affect these setbacks, but the lot <br /> coverage will increase slightly from 20.3%to 20.9%, and is under the 30%requirement. <br /> The homeowners are seeking to make some additions that will allow them to make this there <br /> primary residence. They both work from home, and are proposing a modest second floor addition <br /> to include a home office space. In addition,they are seeking to reconfigure the existing deck which <br /> will largely be in the same footprint. The proposed will not create any new non-conformities or <br /> impact any existing non-conformities. Attorney Klauer concluded that a new Fast IA Septic <br /> System will be installed, and the project was approved by the Conservation Commission. The <br /> proposed project is not substantially more detrimental than what currently exists, and meets the <br /> requirements under §174-17 and §174-33. <br /> GENERAL FINDINGS <br /> The subject property located at 11 Waterline Drive North contains a total of 15,371 square feet of <br /> land. The subject lot is located within the Little Neck Bay Cluster Subdivision and has the <br /> minimum dimensional requirements: <br /> Minimum Lot Size— 15, 000 square feet <br /> Minimum Frontage—75 feet <br /> Minimum Front Yard Setback—30 feet <br /> Minimum Side Yard Setback— 15 feet <br /> Minimum Rear Yard Setback—20 feet <br /> The Board of Health comments dated September 23,2024 were read into the record; "New design <br /> is 3 bedrooms down stairs and 2 upstairs, new septic with Fast IIA technology designed for 5 <br /> bedrooms. Septic plans must be submitted to the Health Department for final approval when the <br /> filing for a Building Permit. " <br /> The Conservation Department comments dated September 13, 2024 were read into the record; <br /> "Resource Areas: Land Subject to Coastal Storm Flowage (LSCSF)". RDA application received <br /> a negative determination with a 4:1 vote with the following conditions: <br /> • Record determination at Barnstable Registry of Deeds <br /> • Micro clover lawn installed <br /> • Impacts to trees mitigated with a native variety if damage/alteration occurs <br /> • Erosion control installed until completion of construction <br /> 2 <br />
