MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> FEBRUARY 12, 2025 <br /> 90 Wheeler Road: Owners, George L. Rice and Jennifer C. Rice request a Special <br /> Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze and replace <br /> an existing single family residential structure on property located in an R-5 <br /> Zoning District, Map 57, Parcel 16, Mashpee, MA. (Received letter from <br /> Attorney requesting a continuance until the February 26, 2025 hearings). <br /> Attorney Christopher Kirrane represents the homeowners. This project is being <br /> presented to the Conservation Commission on Thursday, February 20, 2025. <br /> Ms. Sangeleer read the letter of request into the record. Mr. Furbush made a <br /> motion to accept the letter of continuance. Ms. Sangeleer, second. All were in <br /> favor. <br /> Sitting on this hearing are four regular Board members, and Associate Member, <br /> Michael Milbury. <br /> 33 Russell Road: Owner, Carol A. Marasa requests a Written Finding under <br /> §174-17 to allow for construction of a farmer's porch to the front of a pre-existing, <br /> nonconforming dwelling, and enclose an existing deck to a three season porch <br /> on property located in an R-3 Zoning District, Map 120, Parcel 105, Mashpee, <br /> MA. <br /> Attorney Christopher Kirrane represented the homeowner. Mr. Kirrane made one <br /> procedural note that the front farmer's porch does not require any relief from the <br /> Board because the porch meets the average setbacks from the two adjoining <br /> properties under Section 174-31 fn. 6. <br /> Mr. Morris agreed. <br /> Attorney Kirrane is seeking a Written Finding for the enclosure of the existing <br /> deck. This deck as it exists is 10.3 ft. from the property line and is considered <br /> nonconforming. There is no increase in the footprint; only enclosing it as a <br /> sunroom. <br /> Mr. Goldstein read the Board of Health comments dated February 12, 2025 into <br /> the record; "House to remain 3 bedroom, 3 season room not fit for sleeping room." <br /> Mr. Milbury read the Conservation Department comments dated February 10, <br /> 2025, "Not within wetlands jurisdiction. <br /> There were no comments from the audience.
