MASHPEE ZONING BOARD OF APPEALS
MEETING MINUTES
FEBRUARY 12, 2025
90 Wheeler Road: Owners, George L. Rice and Jennifer C. Rice request a Special
Permit under §174-17.1 and §174-33 of the Zoning Bylaws to raze and replace
an existing single family residential structure on property located in an R-5
Zoning District, Map 57, Parcel 16, Mashpee, MA. (Received letter from
Attorney requesting a continuance until the February 26, 2025 hearings).
Attorney Christopher Kirrane represents the homeowners. This project is being
presented to the Conservation Commission on Thursday, February 20, 2025.
Ms. Sangeleer read the letter of request into the record. Mr. Furbush made a
motion to accept the letter of continuance. Ms. Sangeleer, second. All were in
favor.
Sitting on this hearing are four regular Board members, and Associate Member,
Michael Milbury.
33 Russell Road: Owner, Carol A. Marasa requests a Written Finding under
§174-17 to allow for construction of a farmer's porch to the front of a pre-existing,
nonconforming dwelling, and enclose an existing deck to a three season porch
on property located in an R-3 Zoning District, Map 120, Parcel 105, Mashpee,
MA.
Attorney Christopher Kirrane represented the homeowner. Mr. Kirrane made one
procedural note that the front farmer's porch does not require any relief from the
Board because the porch meets the average setbacks from the two adjoining
properties under Section 174-31 fn. 6.
Mr. Morris agreed.
Attorney Kirrane is seeking a Written Finding for the enclosure of the existing
deck. This deck as it exists is 10.3 ft. from the property line and is considered
nonconforming. There is no increase in the footprint; only enclosing it as a
sunroom.
Mr. Goldstein read the Board of Health comments dated February 12, 2025 into
the record; "House to remain 3 bedroom, 3 season room not fit for sleeping room."
Mr. Milbury read the Conservation Department comments dated February 10,
2025, "Not within wetlands jurisdiction.
There were no comments from the audience. There were no more comments from
the Board.
7
