MINUTES July 15 , 1993 5 BOARD OF HEALTH did request they define the next level of the process and to define the entity and put together the appropriate au- thorities to begin entering into contractual agreements. ,, "We also discussed the history to date, the pretreatment plant design and the current engineering efforts. " "Mr. Brogna assured the towns the military was in favor of the project and would do everything in his power to get it to roll as fast as possible and would be going out to bid next month for the hookups to the wastewater treatment plant." "A few problems the upcoming meeting must resolve is articles for the fall town meeting. " "Mashpee must make a commitment to the project in terms of capitol . " B. " "I did not wish to expose the Board to anything that would question its ethics and credibility but I really have no other choice in the matter other than to present the information that I have. " "We dis- cussed last week and were essentially deadlocked over pro- ceeding with B.F. I . . " "It is my contention that we made a commitment to B.F. I. . "" "Although we may not have a strict legal requirement to proceed with them I think they have a very strong ethical requirement. " "I think in reviewing this many times the only reason that the process was considered to be scrubbed and to start over again was because of the letter and bid submitted by Joe DiMaggio. "" "Only on that basis did the conversation then turn to going out to bid. " "The dis- cussions that were supposed to have proceeded with Town Coun- sel and B.F.I. in terms of contract did not occur and I have to point to John and say it was his responsibility to proceed with that because at that point it was the Boards' wish. " "It appear you took it under your own to essentially stop that process. " Mr. Doherty responded, "That •is your opinion. " Mr. Ball motioned to refer this matter to the towns le- gally appointed procurement officer to proceed with this mat- ter in any way he sees fit because of the deadlock which I cannot legally vote to break, Mr. Doherty seconded, Mr. Greelish opposed. Mr. Greelish stated, "There is an illegal action that has occurred in this meeting. "
