MINUTES July 15, 1993 6 BOARD OF HEALTH <br /> Mr. Ball stated, "The reason I voted for this to go out <br /> to bid is the amount of money involved in recycling. " <br /> "Ethically, I apologize to B.F.I. however, morally I do not. ,, <br /> "If we award this contract to B.F.I . I believe buy putting it <br /> out to bid and getting the lowest bidder we would save the <br /> towns people quite a bit of money. " "Labor alone would save <br /> the town $1500.00. " "There is an additional bidder inter- <br /> ested in the recycling contract. " <br /> Mr. Greelish stated, "This process was subverted. " <br /> "There was a definite conflict of interest presented by the <br /> Chairman of the Board. " "This is illegal . " "This process <br /> buy definition has been given special exemption. " "It is not <br /> possible to create comprehensive bid documents for this pro- <br /> cess that is flexible and benefits towns." "That is why it <br /> is exempt from this process." <br /> Mr. Doherty replied, "That is your opinion. " <br /> Mr. Ball stated, "Town Counsel did render an opinion <br /> that said this could be put out to bid. " <br /> Mr. Greelish stated, "Of course you can. " "The reason <br /> that the State provision exists is as. I stated, it is a ser- <br /> vice and is to be defined and is not in the best interests in <br /> a lot of cases for a community to attempt to come up with a <br /> bid that defines all the bits and pieces. <br /> Mr. Doherty stated, "In this case it is in the best in- <br /> terests. " <br /> Mr. Greelish stated, "The only reason this is taking <br /> place is because of the protest letter presented to this <br /> Board by Joseph DiMaggio and the bid presented to this Board <br /> by Joseph DiMaggio and the subsequent conflict conversations <br /> that occurred in this Board by Mr. Doherty. " "Otherwise this <br /> Board would have proceeded. " "This Board was represented <br /> that the process was continuing with B.F.I . . " "Mr. Doherty <br /> took it upon himself to stop it. " <br /> Mr. Doherty stated, "That is incorrect. " <br /> Mr. Greelish stated, ""B.F.I. informed me that Mr. <br /> Doherty told them all bets were off and the project is going <br /> out to bid. " "My checks with Town Counsel no more discussion <br /> of this document. " <br /> Mr. Doherty replied, "Your perception is incorrect. " <br /> Mr. Greelish stated, ""I will not abide by the opinion <br /> rendered by the towns procurement officer. " "I will ask for <br /> review by the Board of Selectmen as to the appropriateness of <br />
