MINUTES July 22, 1993 3 BOARD OF HEALTH <br /> manager, who had been aware of the inspection, came up to me <br /> and said, "Now what the hell do you want" . " "I had never met <br /> this person before and was surprised that this was said in <br /> front of his staff. " "Words got heated and heated and I fi- <br /> nally informed him I would be back at 6:00 p.m. and expect to <br /> find either a refrigeration company here dealing with the <br /> problem or a refrigeration trailer here with the food trans- <br /> ferred to it, if not the potentially hazardous food will be <br /> discarded. " "At this point the discussion got even more <br /> heated and some more words were thrown out at me so I told <br /> him I would be back at 6:00 p.m. and left. " "At 6:00 p.m. <br /> Mr. Evans and I returned to the facility and found a refrig- <br /> erator company there working on the temperatures. " "They <br /> were not completely satisfactory but enough to not force them <br /> to throw any foods away." "Under the State Sanitary Code you <br /> can hold potentially hazardous foods at open temperatures for <br /> two hours which is why we returned at 6:00 p.m. . " "Mr. Evans <br /> returned in the morning and found things almost <br /> satisfactory. " "It was subsequent to that, that I heard from <br /> Jonathan Miller about the manager's comments about myself as <br /> the health agent indicating that he would have physically <br /> thrown me out of the restaurant should I have returned at <br /> 6:00 p.m. and started throwing foods away. " "That is a <br /> criminal offense to me as the health agent and as a public <br /> official and is based on that and my full Board's knowledge <br /> of this that representatives of Davy's Locker were called in <br /> to this meeting. " <br /> Mr. Dolinsky stated, "The manager you are referring to <br /> is no longer employed with us. " <br /> Mr. Doherty informed Mr. Dolinsky that this Board is not <br /> accustomed to having our health agents treated in a hostile <br /> manner by any of the restaurants in town. "If this kind of an <br /> attitude were to persist then we could not really ensure you <br /> would comply with the State Sanitary Code and then this Board <br /> would direct the agent to conduct very frequent spot inspec- <br /> tions in order to maintain some type of assurance that public <br /> health would be protected. " <br /> Attorney Dagenais relayed, "Davy Locker's has decided <br /> not to serve lunch any longer which means a reduction in the <br /> number of manager's needed. " "The call today simplified who <br /> should be fired. " "My client would in no way condone any <br /> such behavior and was not aware that it had occurred." <br /> Mr. Dolinsky stated, "I was aware there was an inspec- <br /> tion, I was not aware that the manager had an argument with <br /> Mr. McQuaid and threatened him.
