MINUTES December 16, 1993 5 BOARD OF HEALTH Mr. Doherty explained, "Subdivision plans were filed at a time when zoning regulations were less stringent. " "Board of Health regulations required 100' between septic and well locations. " Mr. Ball motioned to grant a 24' local variance from abutting well (lot 36B) to the proposed on-site leaching fa- cility, a 37' local variance from the proposed well servicing lot #39 to the abutting leaching facility, ( lot 36B) , a 35' local variance from abutting well, (lot 38) to the proposed on-site leaching facility and a 40' local variance from the proposed well servicing lot #39 to the on-site leaching fa- cility with the stipulation the easement is filed with the Registry of Deeds and the owner shall connect to public water upon availability, Mr. Doherty seconded, all agreed. 37 Nobska Road, ( lot #38) - Mr. Michniewicz relayed, "We are requesting both State and local variances for this lot. " "Due to the location of the abutting well on lot #36B we are forced to push the leaching facility as far over as we can. " "The system is a 3' x 3 ' leaching trench 20' long with a re- serve area -alongside. " Mr. Ball motioned to grant a 38' local variance from the proposed well servicing lot #38 to the on-site leaching fa- cility, a 40' local variance from the proposed well located on lot #39 to the proposed on-site leaching facility, a 49' local variance from abutting well , ( lot 36B) , to the proposed on-site leaching facility, a 48' local variance from the pro- posed well servicing lot #38 to the abutting leaching facil- ity, (lot 36B) , a 7' State sideline variance from the abut- ting vacant lot and a 5' State sideline variance from the front property line, Mr. Doherty seconded. 53 Tobisset Street lot 76A - Mr. Michniewicz stated, "We are proposing to combine lot #76A and the small lot adjacent to it. " "We are requesting a Ill local variance from the proposed on-site well to the abutting leaching facility, (lot 75B) , a 12' local variance from the proposed on-site well to the abutting leaching facility, (lot 72B) , a 7' State side- line variance from the street line and a 10' State sideline variance from the street line. " "We are awaiting a hearing with the Conservation Commission. " Mr. Ball motioned to grant the variances as stated by Mr. Michniewicz with the stipulation the Conservation Commis- sion issue an "Order of Conditions" , the dwelling shall tie--in to public water upon availability and the combined lots shall be recorded at the Registry of Deeds, Mr. Doherty seconded, all agreed.
