MINUTES February 17 , 1994 6 BOARD OF HEALTH Mr. McQuaid stated, "When I had verified that they had been connected, which was probably within a couple of days after the 13th, the tenants informed me they were moving out the following week. " Mr. Greelish stated, "When this Board was originally alerted to the problem that they didn't have any water and they had an infant and a toddler, we engaged Mr. Halpern at that time that he had to hookup. " "We individually spoke to him on numerous occasions. " "He called us and called us and called us and talked to us and talked to us and talked to us. "" "I don't think anybody told him he did not have to hookup. " "I know I kept telling him, look we don't have any latitude here, we don't want to embarrass you or the Water District and would not want to site you and it dragged on. " "Mr. Ball and I went to the Water District specifically to request some special assistance with Tri-Town. " "Mr. Halpern, at his own option, waited. " "We told him that we didn't have any latitude and that we would have to file on him. " "There has never been a misunderstanding as to what was required. " "I spent at least three hours on the phone with him back then. " "He knew what he was responsible for and what he had to do. "" "I am not happy that he had the wa- ter disconnected as soon as the power was restored to the house. " "I get the impression that he just walked away from it and figured that everything would blow away. " "I think the complaint is valid. " Mr. Ball stated, "I agree with Mr. Greelish, I think the complaint is valid. " "I think Mr. Halpern did not act as a professional or as an elected official should act in this matter. " "I also believe that Mr. Halpern mislead and de- ceived not only this Board but Commonwealth Electric and the Plumbing Department. " "I am prepared to motion to order at least 1 year community service and also fine him $10,000. 00 if he does not abide by our conditions of community service. " Mr. Doherty stated, "I do agree that something should be done. " "In fact, Mr. Halpern knows he had to hookup but he dragged his feet. " "On the other hand, the reason for the stay on the original 48 hours was due to a financial hard- ship. " "I would agree to a reprimand only. " "A lot of little things came into play. " "I am not in favor of trying to impose any type of monetary fine. " "When Mr. Halpern came in Mr. Greelish insisted on swearing him in, we have no au- thority to do that. " Mr. Greelish stated, "This Board absolutely has the au- thority. "
