MINUTES September 22, 1994 4 BOARD OF HEALTH <br /> Mr. Doherty stated, "I will vote favorably to the request providing all rules and <br /> regulations are adhered to and a copy of the company's liability insurance is kept on file." <br /> "Mr. O'Sullivan relayed, "We would like to dispose of our recyclables at the <br /> transfer station recycling center." <br /> Board members agreed Mr. O'Sullivan could dispose of recyclables at the transfer <br /> station recycling center. <br /> Mr. Cram motioned to grant a 1994 hauler's license to Mr. Dan O'Sullivan d/b/a <br /> A.C. Disposal at a prorated fee of $125.00 for calendar year 1994 and to authorize <br /> disposal of recyclables at the town of Mashpee Transfer Station/Landfill Recycling Center <br /> with the stipulation Mr. O'Sullivan submit a $1000.00 bond or passbook and comply with <br /> the town of Mashpee Board of Health"Refuse Regulation", Mr. Doherty seconded. <br /> APPOINTMENT: Harry Miller - 71 Seconsett Island Road <br /> Mr. Miller was in attendance for this scheduled appointment. <br /> Mr. McQuaid relayed, "In 1989 the existing then septic system was certified in <br /> failure by the Board of Health." "At that time the system was upgraded to Title V, <br /> inspected and approved by an engineer and the system then was servicing two cottages." <br /> "Because the well servicing the lot was less then 100' away we set conditions stating no <br /> increase in habitable space, etc.." "Subsequently, the house burned down." "Revised <br /> plans this evening delineate the existing cottage and a proposed new dwelling to replace <br /> the burned one story dwelling." "The proposed garage, being in the flood zone, will <br /> require a 4' frost wall with the slab on top and the existing leaching facility is only 3' <br /> below grade so the 4' wall will impede the lateral flow of effluent." "There is a sideline <br /> variance which was approved previously however, there is a significant impediment of <br /> lateral flow." "The proposed dwelling does appear to have a larger footprint then the <br /> previous dwelling." <br /> Mr. Miller stated, "The habitable space has actually been decreased." "The total <br /> existing living area in the old house was 995', the total of proposed living area is 869'." <br /> "The owner's are aware the existing cottage cannot be connected, the septic tank and d- <br /> box must be relocated and that they must connect to town water." <br /> Mr. McQuaid stated, "We must deal with the proximity of the garage to the <br /> existing flow diffuser system." "In speaking with the Building Inspector today it was <br /> learned because it is in the flood zone and connected to the house a 4' frost wall would be <br /> required." "There is not even 10' to the proposed garage to the flow diffuser's." <br />
