MINUTES October 13, 1994 19 BOARD OF HEALTH <br /> Mr. Cram stated, "If they had the choice and not the obligation then why are each <br /> and everyone of us on our present tax bills being assessed a water district tax." <br /> Mr. Ball stated, "That's up to the Water District." <br /> Mr. Doherty stated, "Eventually you get the benefit of being able to tie into public <br /> water and the fire protection benefit." <br /> Mr. Marsters stated, "What you have happening here is almost a precedent type of <br /> situation here." "If this is a private way and the private way was servicing thirty lots and <br /> there was a loop around and town water came down here and if this gentlemen here was <br /> to come in and was not asking for a variance from the Board of Health would the Board <br /> of Health say you have to take town water down to this lot here." "You couldn't do <br /> that." "Would the Water District even allow that?" "They're going .to say we're not <br /> going to bring it down." "Maybe it's a legal issue or not I don't know, unless you petition <br /> 50% of the owners." "We have a very unique situation here because this is small little cul- <br /> de-sac and we're also working with a developer but if this was a situation like if it was <br /> Meadowbrook Road that came in around here and we purchased this lot here, here's my <br /> lot here, can you make them come down and put town water there" (shown to the <br /> Board)." "Will the water department even do that Steve." <br /> Mr. Ball responded, "I don't know." <br /> Mr. Cram stated, "Each and everyone of us as a taxpayer at this point <br /> unfortunately, on our tax bill are being assessed a Water District charge." "If you as a <br /> taxpayer say to the Water District I want town water, they say no, does that justify you to <br /> continue paying this water district tax." "Isn't that taxation without representation." <br /> Mr. Marsters stated, "It happens all the time now Bob." <br /> Mr. Cram stated, "I realize that." "There's got to be some justification here <br /> somewhere." <br /> Mr. Doherty stated, "This is how the Water District justifies their taxes." "You <br /> are getting a certain amount of fire protection because that fire hydrant is there, the water <br /> is there." <br /> Mr. Doherty stated, "I probably will live to regret this but Kenny raised a <br /> questionable point enough to allow me to decide in your favor for now." "I will motion to <br /> reconsider last week's vote to require the installation of town water and approve the <br />
