MINUTES October 13, 1994 4 BOARD OF HEALTH <br /> only approved by this Board but by the State as well." "There is no trade-off on linear <br /> distances." "There was also a vertical separation issue where the bottom of your leaching <br /> facility must be 4' above the ground water level." "So, until these issues are cleared up <br /> the Board would not be inclined to grant any variances or approve a system to build on <br /> that lot." "I do have the understanding that it does not preclude you from building <br /> another type of structure there that would not require wastewater disposal." "Therefore, <br /> the issue of the lot being totally unbuildable would probably be in question." <br /> Mr. McQuaid stated, "In May of 1988 the Board approved a septic plan for this <br /> property." "It is since then that our regulations have changed and become more <br /> stringent." "It is current regulations that make this lot unbuildable." <br /> Mr. Doherty relayed, "If you propose a system that gives you both the 100' linear <br /> separation and the 4' vertical separation this Board will make every effort to approve it." <br /> Mr. Ball stated, "According to the current regulations we have now it is not a <br /> buildable lot." <br /> Mr. Doherty stated, "With the configurations of the wetlands as it is flagged out <br /> on this plan there is no way to get the linear 100' separation and the vertical 4' separation <br /> may be possible in an alternative spot however, the linear seems to be impossible." <br /> Mr. Cram stated, "It is the consensus of this Board that due to current regulations <br /> and revised plans dated April 1988, 999 Waterline Drive is deemed unsuitable for <br /> installation of a leaching facility on the lot, Mr. Doherty seconded, all agreed. <br /> APPOINTMENT: Ken Marsters - #7 & #9 Windermere Way <br /> Mr. Ken Marsters was in attendance for this scheduled appointment. <br /> Mr. Marsters presented the subdivision plan and stated, "We were not the <br /> developer who put the road in and the underground utilities." "We purchased all the <br /> circled lots from the bank about two years ago" (shown to the Board). "We started <br /> building these lots and are down to two lots ( #7 & 49 Windermere Way), whose <br /> topography is terrible, they slope down which is one of the reasons why they are the last <br /> lots to sell." "When we went in there and originally did the septic plan that Bob did on <br /> July 21 st and July 24th, we went in there and as with these lots here assumed there was <br /> town water." "Come to find out Peter Fitzpatrick, who works for me, used to work for <br /> Jim Gill said, "You know something there is no town water down there"." "I said, you <br /> have to be kidding me, there is no town water down there?" "I had no idea." "When Jim <br /> s. <br />
