MINUTES October 13, 1994 5 BOARD OF HEALTH <br /> took the water down he took it all the way down here" (shown to the Board). "When Jim <br /> bought it from John Sullivan, John Sullivan had developed a few houses in here, (lots <br /> closest to Route 28), which were all on wells." "They didn't want the town water so Jim <br /> went right by them with the water line." "We're sitting down, right in here right now, and <br /> we don't own this lot, this lot is on a well of the house that's built, we don't own this lot, <br /> this house in on a well and it's built." "So, really there is no way that we can get into <br /> these two lots, right here, unless we were to cross private property." <br /> Mr. Doherty questioned, "Do they own to the center line?" <br /> Mr. Marsters responded, "They own to the center line." <br /> Mr. Doherty questioned, "Are there utility easements." <br /> Mr. Marsters responded, "I am sure there are utility easements in there." <br /> Mr. Doherty stated, "Water classifies as a utility." <br /> Mr. Marsters stated, "Right, for you to do that, right, absolutely." <br /> Mr. Ball stated, "I have no problem rescinding the vote from last week." "It's up <br /> to you two." "If you remember we thought that Kenny had owned this whole <br /> development." <br /> Mr. Marsters stated, "I am sure that was the assumption, the assumption was <br /> probably that I developed the property and that I even owned these lots here." "I am sure <br /> the town hasn't taken them." <br /> Mr. Doherty commented, "I am hesitant only because here is a good opportunity <br /> to provide town water which, if we miss it now, may never come again." <br /> Mr. McQuaid relayed, "My feeling is, there is one developer that purchased these <br /> lots." "He is developing the lots, town water is available to the development." "Whether <br /> or not he has to cut through the utility easements to supply these two lots down here with <br /> town water is irrelevant to me, in so far as, town water is available 100' away." "It is not <br /> like Joe Smo bought this lot and we are telling Joe that you must pay to run this line down <br /> Windermere Way to supply your house with water." "It is a developer we are talking <br /> about not a homeowner." <br /> Mr. Ball stated, "He is not asking for any variances from the 150', there is no <br /> plume, no anything in this area."
