MINUTES October 13, 1994 6 BOARD OF HEALTH <br /> Mr. McQuaid stated, "Then why are you guys saying, if town water is not <br /> available then sign this statement that when town water becomes available....." <br /> Mr. Ball stated, "If he is asking for a variance." "That is only if he comes under <br /> the 150' or the separation from septic and well, that is only when it kicks in." "There are <br /> no variances asked here from well to septic." <br /> Mr. Marsters questioned, "If I was to bring town water in here would I have to <br /> service all the lots in there or just service only down to there?" (show to the Board). <br /> Mr. McQuaid responded, "Service the ones that you are about to build upon_" <br /> Mr. Cram stated, "At their cost." <br /> Mr. Ball stated, "You have to pay for the water to go down there." "You don't <br /> have to pay for that main as it is." <br /> Mr. Marsters questioned, "Who has to pay to cross the private property?" <br /> Mr. Ball responded, "I don't know who would have to pay." "Look, I have no <br /> problem with the well in there." "Let these two decide what they want to do." <br /> Mr. Marsters stated, "I think if this was one private individual or two private <br /> individuals I don't think and I highly doubt that you have made anybody bring water or the <br /> Water Department has made anybody bring water to another piece of private property, I <br /> do not think you can legally stand here and say because you are a developer you should or <br /> whatever." "The fact of the matter is I had nothing to do......" <br /> Mr. Doherty stated, "We can declare the only acceptable source of water." "If it is <br /> within a reasonable amount of distance then that is it and you really don't have any <br /> recourse." "You can take us to court, your not likely to win." <br /> Mr. Marsters stated, "That is not my intention, my intention here is to deal with <br /> common sense." "It is not available there if it is 100' from it." "Is availability 100'." "I <br /> have a home right now that I would love to have town water from and I can't get it <br /> because my neighbor's don't want it and I am only 300' from it but it is not available to <br /> me." "I would love to have town water." "I am not anti town water, I am putting town <br /> water in all of our places." <br /> Mr. McQuaid questioned Mr. Marsters, "Then you are you objecting here." <br /> S <br />
