MINUTES October 27, 1994 10 BOARD OF HEALTH <br /> 51 MONOMOSCOY R.D. WEST - Mr. Evans relayed, "Due to the complexity of the lot <br /> engineered plans will be required. <br /> Board members forwarded their signatures to the "Emergency Repair <br /> Certification" form. <br /> 13.) Septic permit extension request, 46 Amos Landing. Road - Mr. McQuaid relayed, <br /> "The owner is requesting a septic permit extension." <br /> Mr. Cram motioned to grant a 6 month perc extension from date of expiration, Mr. <br /> Doherty seconded, all agreed. <br /> 14.) Septic plan. 165 Willowbend Road - Mr. McQuaid relayed, "All of Willowbend <br /> was originally expected to be serviced by a treatment plant." "When Mr. Hostetter owned <br /> the plant the issues of operation and maintenance responsibilities of the treatment plant <br /> were not yet ironed out by the D.E.P.." "Subsequently, when Mr. Fireman bought the <br /> property he negotiated with D.E.P. and agreed legally to condominiumize the entire resort <br /> so that anyone who purchases a lot in Willowbend will be part of a condominium <br /> association which will then be held responsible for the operation and maintenance of the <br /> treatment plant." "There were 27 lots when Mr. Hostetter owned Willowbend that were <br /> already sold individually." "These property owners now cannot be forced into the <br /> condominium association." "They own their lot, it is not a condo." "Now we are faced <br /> with allowing these homeowners who do want wish to join the condominium association <br /> to put in standard Title V systems." <br /> Mr. Doherty questioned whether there are any provisions in the law to have a <br /> private person tie into the system and pay a fee. <br /> Mr. McQuaid responded, "No, absolutely not." <br /> Mr. Doherty motioned to approve the installation of a Title V leaching facility at <br /> #165 Willowbend Drive, Mr. Cram seconded, all agreed. <br /> 15.) Barnstable County B O.H.'s Annual Dinner Meeting, 11/16/94 - Acknowledged. <br />
