MINUTES October 27, 1994 9 BOARD OF HEALTH are cleared and we hear the intent is to bring town water when we have new construction." "I don't understand." Mr. McQuaid stated, "I would like to bring attention to the letter from the Board of Health dated April 10, 1990 which indicates the developer at that time was aware of the fact that no occupancy permits would be issued to any vacant lots to be developed until town water becomes available." "That is quite clear." Mr. Ball stated, "The Board is staying by their decision of two weeks ago." 10.) Amended agreement with William_Haney - Mr. McQuaid stated, "Several weeks ago we received the proposed agreement from Mr. Haney." "The Board was not satisfied with the letter as it didn't hold Mr. Haney responsible to complete the septic systems during a required time frame." "The letter now states MEZ Realty, Inc. will complete five new septic systems including emergency repairs for the calendar year." "The understanding is as long as the corporation has the funds available to replace the septic systems." "The reason why its was worded this way was due to the fear of rent control." "If the Board so wishes to reword it I will make the corrections and present them to Mr. Haney for his approval." Mr. Doherty agreed to make the necessary changes as discussed. 11.) Variance request, 7 Deer Ride Road - Mr. McQuaid relayed, "The owner is requesting a 25' local variance from abutting well to the on-site proposed leaching facility." Mr. Ball stated, "This plan is not complete as a variance was omitted." "I would recommend we require the engineer to revise plans indicating the distance to the abutters well, (House #11 Deeridge Road), to the proposed on-site leaching facility." Board members agreed. 12.) Emergency failure certification - 177 Walton Heath Way and 51 Monomoscoy Road West 177 WALTON HEALTH WAY- Mr. Evans relayed, "I inspected the site and found the leach pit full." "There is a Title V system however, it needs a new leach pit." Board members forwarded their signatures to the "Emergency Repair Certification" form..
