MINUTES October 27, 1994 8 BOARD OF HEALTH
this office." "It further states any future request for well installations will be handled on a
case by case basis relying strongly on the information requested from the bank in
paragraph one above." "Another particular letter dated April 10, 1990 addressed to the
members of the Highlands homeowners association from the Board of Health states, after
meeting with the Multivest Properties Inc. representatives this past March, the Board of
Health agreed to allow this firm to begin construction on the remaining lots of the
subdivisions formerly known as "Ramsgate" on the condition the developer would not
request occupancy permits until public water was available to the remaining vacant lots."
"There is another letter from the Mashpee Water District dated February 8, 1990 to Jim
Gill, President of Multivest Properties referenced the Highlands formerly Ramsgate which
states the Water Commissioner's on February 6, 1990 approved the request to connect to
the Mashpee Water District Route 28 water main to provide potable water to the
following private streets; Dover Road, Nancy Lane, Kings Court, Cransbourne Circle
and also 6" stubs into Oxfordshire Place and Windermere Way - Oxfordshire Place and
Windermere Way may be completed also under this permission if it becomes desirable to
do so." "For some reason the Board in the past was requiring town water there."
Mr. Ball stated, "We will take them on a case by case basis." "I guess to say the
Board's feeling is a 2 to 0 vote and I think it will stay." "The Board is granting Mr.
Marsters, Prime Properties, to have the option of wells or town water." "The avenue Mr.
Potts may want to pursue is on a higher level."
Attorney Carter stated, "Today was more of an information gathering session
because we heard conflicting reports." "It was clear by the letter from the Board of
Health that it was a precondition." "There wasn't a day Mr. Gill did not come by my
office to complain about what the Board of Health was requiring him to do." "I would
suggest the readily accessible issue was brought out by Mr. Gill when he was the
developer, which was he must bring the pipes right down the center of the development
which is what he did." "To say that there is not readily accessible problem because you
don't have to go off to the left or the right of a cul-de-sac I just don't buy that." "If you
want to look at the hardship for each lot owner in there that doesn't have it, would far
outweigh any hardships of the new developer."
Mr. Potts stated, "When we had the hurricane we were without electricity and
water for a week." "Our neighbor had just been released from the hospital and it was a
hardship for him to get water for the toilets and ended up reopening his stitches and was
returned to the hospital." "We were always lead to believe that once those lots were to be
developed that town water would come and then we would hookup from our house,
which is 150' from where the fire hydrant goes anyway, we would hookup at that point in
time and we were patiently waiting for the last five years." "We finally see the two lots
