MINUTES December 29, 1994 5 BOARD OF HEALTH <br /> Mr. Ball questioned, "Are all utilities up there." <br /> Mr. Raymond responded, "There is water and gas to the property." <br /> Mr. Doherty stated, "We do need a legal document stating you own to the center <br /> of the road or at least shows property lines to where the center of the road is." <br /> Mr. McQuaid stated, "Great River is a tidal influenced wetland." "Our regulation <br /> states that the septic leaching facility must be 100' from the top of the bank from a tidal <br /> coastal bank." "You can see what Mr. Raymond has designed for a designated <br /> discretionary zone that the leaching facility, even in the middle of the road, is within the <br /> 100' buffer from the top of the bank." "We use the Conservation Commission's definition <br /> of wetlands just as a matter of concurrence." "The system as proposed definitely falls <br /> within the 100' separation that we have under regulation." "This Board has in the past <br /> allowed for the installation of either a well or septic system across the paper street as long <br /> as the owner of the property in question also owns the property on the other side of the <br /> street." "We have never allowed anything be it a well or part of a septic system to be <br /> developed on a paper street be it privately owned or not." "In my opinion, those two are <br /> key issues." "We can't go by the edge of the vegetated wetland we have to go by the top <br /> of the bank." <br /> Mr. Ball stated, "We have gone by the edge of the vegetated wetland before." <br /> L <br /> Mr. McQuaid responded, "Not on a coastal bank." <br /> 6 <br /> Mr. Ball questioned, "Did Bob Sherman have any question with this?" <br /> Mr. Raymond responded, "No, I showed it to Bob today." <br /> i <br /> Mr. Ball stated, "If the Bob Sherman does not have a problem I'm not sure why <br /> we would." <br /> Mr. Raymond stated, "We did not hit groundwater." "We did a 10.5' test hole at <br />` elevation 12.37." <br /> Mr. McQuaid commented, "We also have a soil stability regulation which requires <br /> 150'."
