MINUTES December 29, 1994 5 BOARD OF HEALTH <br /> Mr. Raymond commented, "The Court is making up the deed because there are a <br /> number of owners of this particular property." <br /> 11 Mr. Doherty stated, "I would like to await this Board rendering a decision until the <br /> deed has been drafted." <br /> Mr. Ball stated, "I don't have a problem with this as far as the leaching pit going in <br /> the road provided that it is a heavy duty trench and if the Planning Board agrees we could <br /> go that route too." <br /> Mr. McQuaid commented, "The Planning Board wouldn't be involved." <br /> Mr. Cram stated, "Even though it is a private road there is public access to it." <br /> Mr. Doherty stated, "I have reservations." "The fact that you have admitted that <br /> the deed is so complicated that is goes back to 1913 with seventeen parties involved." <br /> "Even though you say the deed is drawn and settled, if we approve it something may <br /> surface." "I would like to see the road off the plan." "If you're not going to build it why <br /> have it on the plan." "If it not longer becomes a road then the road is not an issue." "As <br /> far as the distance, if it is not a sand dune which is subject to changes in composition or <br /> shifting, then I would approve the distance measured from the edge of the wetlands." "If <br /> we can resolve those two issues then there should not be problem installing the system." <br /> Mr. Raymond stated, "The next deed is going to be drawn to Mr. Benway." "We <br /> can produce a deed to show that ownership is to the center of the paper street." <br /> Mr. McQuaid stated, "We will require the Conservation Commission Agent verify <br /> the wetland delineation." <br /> Mr. Doherty motioned to grant a 8' sideline variance with the stipulation a deed is <br /> presented which states ownership is to the center of the road, the plan must be approved <br /> by the Conservation Commission, the owner must record on the deed that the road will <br /> never be developed and the abutter to the west of the paper road must forward a letter <br /> stating no objection to the placing of the leaching facility within 10' of his property line, <br /> Mr. Cram seconded, all agreed. <br /> Being no further business Mr. Cram motioned to adjourn this meeting at 7.50 p.m., Mr. <br /> Doherty seconded, all agreed. <br />
