MINUTES March 30, 1995 7 BOARD OF HEALTH
"There was 9" of top and subsoil and groundwater was measured at 5' below grade."
"We require 4' of separation." "This lot was perked twice before back in 1984 where
groundwater was measured at 4' now you have 4'.3"." "A monitoring well was installed
and the engineer was to measure the tidal influence on that monitoring well which we do
not have."
Mr. Borselli stated, "We did monitor the well." "The plan was designed as close
as possible to Title V and local regulations." "We can only maintain 55' from a reserve
area." "This is an informal meeting." "If there is anything we can offer in the way of
denitrification systems, deed restrictions, etc. anything that the Board may consider due to
the fact that the substantial hardship is that we are surrounded by water on three sides and
the property owners have owned the land since the 1930's and the regulations have
changed." "We did install a well and it was monitored." "The adjusted ground water
table is on the plans and we did meet the 4' separation."
Mr. McQuaid commented, "The existing house that your sister owns probably has
an old cesspool." "Could the distances to the wetlands on both sides be increased were
your sister to agree to install a Title V system on her property and size that sufficiently to
have you build your two bedroom house."
Mr. McLeod responded, "We thought of that but you don't get that much more
distance."
Mr. Doherty commented, "Just a straight Title V component system, when your
asking for significant variances, I would be inclined to vote to deny."
Mr. Borselli stated, "What if we also offered as part of the proposal that we could
upgrade the cesspool that is sitting in water." "We could also take the entire system, both
houses and upgrade it to a denitrification system."
Mr. McQuaid stated, "The question is there is a 100' setback requirement to the
wetlands." "You propose a denitrification system and you can only meet 60' to the
wetlands." "How much does that denitrification system buy you as far as distance to
wetlands." "That is something the engineer has to convince the Board of." "They don't
have 4' of naturally occurring soil between grade and groundwater and we just received
word we were upheld on our regulation."
Mr. Borselli stated, "We do have 4' of naturally occurring soil in an alternative
location on the lot."
