MINUTES June 29, 1995 22 BOARD OF HEALTH
owner shall reimburse the town in full or a lien shall be placed on the property, Mr. Ball
seconded, all agreed.
Ms. Amaral questioned, "Can you write this down what you're tallying about
because I don't know exactly and I want to run it by a few people."
Mr. Doherty stated, "It will be in the minutes which will be available next week."
Mr. Ball stated, `Basically, what you can tell the people is that the Board voted to
fix your system tomorrow whether we do it or they do it and he has 48 hours to get it
fixed, by 4:00 if it's not fixed he will face fines." "It will be fixed tomorrow or if we can't
get a pumper out there we will continue pumping it until it's fixed."
Ms. Amaral stated, "I understand that because that's what you've been doing."
Mr. Ball stated, "That's what's going to happen tomorrow and this problem will
go away."
Ms. Amaral stated, "I just don't understand, now I've talked to the contractor's
who have come down." "I mean, they keep coming down at 5:00 in the morning which I
think is an unreasonable time to have someone come down and they're telling me this is
only between a $2500.00 job." "These people are riding around Mercedes Benz and stuff
and they don't have $2500.00 to throw down." "I mean, they have lied to us from the
beginning." "Sure, I can move." "I have a Section 8, I can move but I shouldn't."
Mr. Cram stated, "Mercedes Benz, all it means is they get good credit it doesn't
mean they get money it means they get good credit."
175 Surf Drive
Mr. McQuaid relayed, "Subsequent to last week's meeting I heard from Kate
Connolly, an attorney with Town Counsel who indicated that our reconsideration of the
variance granted, under the open meeting law, wasn't legal and suggested we contact the
engineer and conservation agent to indicate to them that the Board will, at a future
meeting, reconsider." "The Conservation Commission agent did indicate that flag 95 had
not been verified and may require greater variance relief than voted by the Board."
Mr. Cram stated, `Based on the information we had at a previous meeting when
we made our decision was not correct." "We have the right, to my knowledge, to
reconsider based on that."
