MINUTES August 10, 1995 4 BOARD OF HEALTH <br /> Mr. Perry stated, "Now, you live in a home and the pump is leaking badly for three <br /> days, you're not going to panic, you not going to want to get into that buildino-, your not <br /> going to take care of that problem and when you see it is not leaking you're not going to <br /> take it to somebody?" <br /> Mr. McQuaid replied, "I don't question that but I don't know about the legality of <br /> a landlord entering a rented unit without the tenant giving you permission to do so and <br /> usually, it's done so under the conditions that they be present." <br /> Mr. Perry stated, "If your water pump or house was on fire or your pump was <br /> leaking and you owned it I have the right to save my dwelling." "Why didn't the police <br /> arrest me." "He never hit the bottom of the stairs to see if the pump was leaking." "He <br /> should have never put that language in there." "That made me go into that building <br /> thinking I had an emergency there, which I have a right to do." "Now, these tenants are <br /> trying to pull me into court because of inadequacies from this office." <br /> Mr. Doherty questioned, "Why are the tenants upset?" <br /> Mr. Perry responded, "Because I went into the house to save the pump from <br /> flooding the cellar." "The pump is fixed, it's back in and the plumber is there now <br /> hooking the thing up and it is fine." "It wasn't the pump, the tank was sweating." <br /> Mr. Evans stated, "I can't believe that a tank sweats that much that it would cover <br /> 1/3 of the entire floor." <br /> Mr. Perry stated, "The bottom tray for the tank is to small." "With the humidity <br /> we're having you can tell." <br /> Mr. Cram questioned how big the basement area is, 28' x 327' <br /> Mr. Perry responded, "Yes, easily." <br /> Mr. Evans stated, "I'm sorry for the way that I "Tote this." "I'm not sorry that I <br /> did the inspection." <br /> Mr. Perry stated, "Number l violation is not true and neither is Nurnber 2." "That <br /> building is not habitable at this time." "The day you did the inspection there was nobody <br /> there and you're getting involved into a dispute between the two people who live there <br /> and have a dispute about their bill." "That shouldn't become a health department <br /> problem." <br />
