MINUTES July 16, 1998 4 BOARD OF HEALTH <br /> Dr. Segal commented, "We know how to do that and we do that on a daily basis." <br /> Mr. McQuaid stated, "I also spoke with someone from Barnstable County who <br /> concurred that it would set a bad precedent if we allowed this variance and the regulation <br /> does not even take effect until January of 1999." <br /> Dr. Segal commented, "This particular mandate is aimed at the commercial <br /> situation_" "Here we just don't have this type of traffic." <br /> Mr. Doherty relayed, "I don't agree with you." "A pool that big is not a family <br /> pool in the backyard." "Sixty-five potential families potentially using the pool is a <br /> commercial operation." "You have a commercial operator caring for your pool." "So far <br /> you have described an inconvenience not a hardship." "Most pool operator's will obtain <br /> the certification." "I don't see any hardship here whatsoever." <br /> Mr. Cram informed Dr_ Segal, "Just because an individual does not want to take <br /> the course or to be certified is not a reason for us to grant a variance." <br /> Mr_ Doherty motioned to deny the variance request, Mr. Ball seconded, all agreed. <br /> 1.) Mr. Ball motioned to accept the minutes of June 25, 1998, Mr. Doherty seconded, <br /> all agreed. <br /> Mr. Bail motioned to accept the minutes of July 2, 1998, Mr. Cram seconded. <br /> 2.) Pond V.O.C. test results of June 1.0, 1998 - Mr. McQuaid relayed, "All ponds <br /> came up clean." <br /> Acknowledged. <br /> 3.) Pond Fact Sheet - Mr. McQuaid relayed, "There continues to be an elevated level <br /> of mercury in fish in John's and Mashpee/Wakeby ponds." "It's not at the level where it <br /> would be dangerous but it is enough for a warning." <br /> Acknowledged. <br /> 4.) Human Services Contracts for signature's - Board members forwarded their <br /> signature's to the fiscal year 1999 human services contracts. <br />
