MINUTES July 23, 1998 6 BOARD OF HEALTH <br /> Mr. Slavinsky relayed, "The effluent from this particular house is not going to get <br /> to the bay." "If it does get to the bay it's right at the mouth of the bay." "There is <br /> approximately 800' of marsh to get to the water." " <br /> Mr. McQuaid stated, "This is a pre-existing dwelling with a failed system." "What <br /> they are proposing is much better than what is existing." "I can't recall that we have ever <br /> required a denitrification unit for a failed system." <br /> Mr. Doherty commented, "We have always asked." "You are asking us to give up <br /> something." "We want to know what you are doing to mitigate the lesser distance." "Our <br /> interest is public health including water quality in the bay." "If the circumstances indicate <br /> that that material we're concerned about, the nitrates, will not enter the bay but they will <br /> in fact be taken up by the salt marsh, then we could consider a variance on that basis." <br /> Mr. Slavinsky stated, "I would go along with that in this particular case." <br /> Mr. Doherty motioned to grant the variance relief as follows: a I.8% reduction in <br /> the leaching capacity, a 5' sideline variance from the adjacent property, a 10' variance <br /> from the State owned parcel, and a 4' local variance from abutting well, (#128 <br /> Whippoorwill Circle), to the proposed on-site leaching facility, based on the following <br /> findings; this is an existing dwelling with a failed system, the engineer's has stated, in his <br /> opinion, the nitrates in the effluent will be taken up in the salt marsh and the proposed <br /> leaching facility is designed in compliance with Title V requirements regarding maximum <br /> feasible compliance, Mr. Ball seconded, all agreed. <br /> APPOINTMENT_ BSS Design-Tom Bunker and M. Grotske (Aunt Jane's Road) <br /> Mr. Tom Bunker, Mr. Michael Grotske and Mr. Gary Eynatian abutter, were in <br /> attendance for this scheduled appointment. <br /> Mr. Bunker stated, "There are three lots before the Board tonight which we are <br /> requesting variances from the town requirement of 150' between a leaching pit and a <br /> private well." <br /> Mr_ Doherty commented, "There are six lots shown on engineering plans however, <br /> I <br /> the assessor's map only shows two." <br /> Mr. Bunker responded, "There is a land court subdivision plan however, it hasn't <br /> been issued by them yet." <br />
