MINUTES July 23, 1998 8 BOARD OF HEALTH
definitely the well is on the wrong property." "I tried to get in touch with the well driller
but he hasn't responded to me yet however, he did respond to the abutter who's well is
being affected." "Hopefully, the well driller will realize his mistake and re-drill the well on
the proper lot." "If not, they are accusing the town of malfeasance in that we, the Board
of Health, should have been out there to certify where the well went in because they think
it is one of our inspection requirements." ""It isn't, we approve the plans." "The well
driller is licensed by the State not the town."
Acknowledged.
Mr. Klein stated, "We found some lot markers and we measured." "I originally
put up a sand mound to separate both of my properties on both sides." "When I did it I
realized I was two or three feet on the difference of the property line." "'Phis particular
well goes way beyond my sand marker." "There are a couple of problems, I have a nine
month old baby and I don't need to lose water and my wells not working properly." "The
other problem is that the owner may fill in the hole because they are planting grass." "I
think someone should take pictures."
Mr. Doherty informed Mr. Klein, "The engineer is responsible to stake the location
of the well." "If he didn't do that then it is an issue between you the well driller and the
engineer but if in fact he did put it where the stake was that is an issue between you and
the engineer."
Mr. Klein commented, "I spoke with the engineer who said he can't be responsible
for putting the stake up because kids move them and what not." "I need advice from the
Board of Health."
Mr. McQuaid relayed to Mr. Klein, "I know you feel that this is not your
responsibility, and I agree with you and I want to work with you on this but I would
consider hooking to town water." "I spoke with the Water District.who said they would
work out any kind of payment plan that's comfortable for you for as little as $50.00 a
month." "These lots are so small out there and we have had problems with high nitrates in
some of those wells." "We encourage people to connect to town water."
Mr. Klein stated, "Doesn't the engineer have to sign-off signifying that installation
was done correctly?"
Mr. McQuaid responded, "That's correct." "Mr. Costa drew the plans and went
back inspected the layout, inspected the septic system and signed off on an"As Built" card
which means this went in according to plan."
