"One other point I would like to make is that the <br /> issue of providing Mr. Eynatian with public water was at his request." <br /> Attorney Snow stated, "So this is the plan based on the presumption, assumption <br /> that the well is within the house which is based on other wells in the area that their inside <br /> the house." <br /> Mr_ McQuaid stated, "You can't assume that." "You have to redraw the arc <br /> expecting the well to be at each corner of the lot." <br /> Attorney Snow stated, "If Mr. Eynatian refuses to disclose the location of the well <br /> for the purpose of variances you wouldn't be using this (shown to the Board) as the <br /> starting point, you would be using the four corners." <br /> Mr. McQuaid responded, "Right." <br /> Attorney Snow stated, "I was not privy to reviewing plans before tonight." "I will <br /> certainly talk to my client." y' <br /> Mr. Doherty stated, "We can't grant a variance based on an assumption unless you <br /> can completely rule it out by using the edges of the lot line as the possible location." <br /> "You can't say I think it's in the house so we can't grant the variance, he can't move <br /> forward with the project and it's all because somebody won't tell us where it is." <br /> Mr. Ball motioned to continue this matter until the August 20, 1998 public meeting <br /> date, Mr. Doherty seconded, all agreed. <br /> Mr. Doherty informed Attorney Snow, "The State requires 100' separation <br /> between well and septic, the town requires 150'." "The reason for that is the sandy soils <br /> on the Cape." "In a lot of the preexisting subdivisions which were all cut up and laid out <br /> before the town adopted the 150' separation it has been customary and we review them on <br /> a case by case basis, for us to grant a variance down to the State minimum." "If it comes <br /> up to the 20'h and no resolution has been found I'll motion to deny this because I can't do <br /> it based on an assumption but this Board is open and they can reapply at any time." <br /> 3.) Landfill closure SRF approval - Mr. McQuaid stated, "This indicated that Andy <br /> Gottlieb has approved us for the SRF program as far as closure of the landfill and negative <br /> interest." <br />
