MINUTES August 27, 1998 8 BOARD OF HEALTH Mr. Eynatian stated, "The town had liens on this land right now for non-payment of taxes and also, as far as the town is concerned they're not even owned by the individual who is applying for this so I just don't understand why the Board feels compelled to act." Mr. Cram stated, "We do not understand your objections sir in regards to this unfortunately." "That is my opinion." Mr. Eynatian stated, "You're accepting applications on lots that don't exist in that format and in the previous format that they did exist they're tax delinquent and there are liens on the property placed by the town." "I read you the exact article that says that the Board can deny applications, did L" Mr. Cram stated, "You have basically refused at this point to comply with our request so we are having to react and make a judgment based on the knowledge that we have available." "Unfortunately, that's what we have to do." "So, until any further knowledge comes forth that we have asked for I do not feel in any way that we can make a different judgment Mr. Eynatian stated, "That's fine but they can't have a four bedroom house on an old pre-Title V septic, it's against the law." "If it's a pre-Title V they can only have a three bedroom one bath." Mr. Cram stated, "At this point I'm going to defer to our health agent for advice in regards to this." Mr. Ball stated, "This is what I was trying to explain, that's why I wanted your engineer to call me." "We needed well, assuming that it is on this corner, to septic exactly." "So, what I was going to explain to him, that you would take the north corner to lot L... Mr. McQuaid stated, "Specific distances that are less than 150'." Mr. Ball stated, `Because this wasn't specific." "That's why I was trying to get a hold of him." Mr. McQuaid stated, "And I happened to agree with Mr. Eynatian, this is a public well re-charge area and since you have less than one acre you are limited to three bedrooms." i
