MINUTES September 10, 1998 4 BOARD OF HEALTH <br /> Mrs. Miller stated, "We have flooding in our basement." <br /> Attorney Carter stated, "If the pert test was performed back then it wouldn't have <br /> passed." " <br /> Mr. Doherty questioned, ` Vas there ever a time when it was accepted practice <br /> that health agents do not personally witness a soil test?" <br /> Mr. McQuaid responded, "No, not since the original Title V came into effect and <br /> that was in 1977." "Coincidentally, this system was installed in 1976." <br /> Mr. Doherty commented, "So this is prior to Title V7 <br /> Mr. McQuaid responded, "Correct." <br /> Mr. Doherty stated, "Prior to the time when it became accepted practice for the <br /> health agent to witness the soil logs." <br /> 5 <br /> Mr. McQuaid responded, "Yes." "We do have engineered plans but there is no <br /> evidence that the Board of Health witnessed the soil test." <br /> Attorney Carter commented, "On the Title V application it states that Harold <br /> Collins witnessed the soil test." <br /> Ms. Miller stated, "We didn't have a leaching field and if we didn't have the water <br /> table so high it would have lasted us a little bit longer, don't you think?" <br /> Mr. Doherty responded, "Well, that's a variable that nobody could really pin down <br /> as far as - the issue here is responsibility for the certification of the system." "Obviously, <br /> the Board isn't responsible for certifying it." "What was actually there when they dug it <br /> �» <br /> up. <br /> Mr. McQuaid responded, "The pit." <br /> Mr. Doherty questioned, "Just the pit, no tank?" <br /> Mr. McQuaid responded, "There was a tank." "There wasn't a leach field." "It <br /> wasn't high, it was a deep system that was probably half in groundwater." <br />
