i
i
I
MINUTES September 10, 1998 5 BOARD OF HEALTH
i
I
i
Attorney Carter stated, "I wanted to brief the Board however, I haven't put a
formal demand." "They wouldn't be in this predicament if it wasn't for all the past things
that we have already discussed." "What they ultimately have is a problem." `What they
have been told is to jack up their house and that's an expense."
Mr. Cram questioned, "Is their anything the D.P.W. may be able to help with as far
as the flow of groundwater that's coming down that area to divert it away from the
house?"
Mr. McQuaid stated, "Their corner on South Sandwich Road is the low spot."
"Even if they connected the road drains by piping to the other side of South Sandwich
Road closer to the bogs I don't think it will permeate there, I think it will just backup and
stay." "Your case is you purchased the property based on an inaccurate engineering
plan." "Whether you have a case against the town is between the lawyers."
Mr. Doherty stated, "I think we all agree that what we see on paper is not
accurate."
Attorney Carter stated, "I'll send a letter as to what we think is fair and you'll pass
it on and we'll go from there."
APPOINTMENT: Cape& Islands - I I Pond Street (Preliminary)
Mr. John Slavinsky, representing the engineering firm of Cape & Islands
Engineering was in attendance for this scheduled appointment.
Mr_ Slavinsky stated, "Mr_ Evans and I did a test pit and hit groundwater at
4'l l"." "This is repair system to an existing house." "The perc rate is above 2 minutes
per inch." "We are contemplating as to whether a denitrification unit should be installed."
Mr. Doherty commented, "I would consider a variance if the applicant proposed
the installation of a denitrification unit."
Mr. Slavinsky stated, "The variance would be a l' variance from the 4'
requirement between the bottom of the leaching and groundwater."
Mr. Ball stated, "I would vote in favor of the variance if the applicant proposed a
denitrification unit."
i
