MINUTES July 1, 1999 5 BOARD OF HEALTH
falling in; it's clearly an improvement. It's a very, very difficult lot. We can all
appreciate that."
i
Mr. McQuaid added, "He couldn't put another bedroom in based on how the
system is proposed."
Mr. Doherty motioned to grant the variances of 5' from the soil absorption
system to the street and northerly property lines, 5'from the soil absorption
system to the garage foundation, 53'from the soil absorption system to the
BVW line and 1'from the soil absorption system to the monitored high water.
Mr. Cram seconded the motion. Motion passed.
Variance request: 28 Birch Way
Mr. Doherty motioned to deny the application based.on it being an incomplete
submittal. Applicant is asked to resubmit the application.
8. Emergency_ Failure Certification: 28 Gunters Lane
Mr. McQuaid stated that there is not 24-hours capacity in the leach pit and
that a new pit (reserve) should be installed per the plan.
Board members forwarded their signatures to the Emergency Failure
Certification form.
NEW BUSINESS
Update on Finally Dino's
Mr. McQuaid stated, "They have an 8,000 gallon tank. Based on the number of
seats without the outdoor seating it should be a 12,000-gallon tank. He's got a
2,000-gallon grease trap, which should be a 3,500-gallon grease trap. When he
expanded Dino's Sports Bar we made him open up his reserve. That took care
of the leaching facility. Now he wants to expand to another 64 seats outside;
that made me look at the size of the grease trap and septic tank. The leaching
is okay, but the tank is slightly under and the grease trap is slightly under. I
called the DEP on this because one of the things that should be taken into
consideration is that Dunkin' Donuts, Chopsticks and Dino's all use paper
goods. There is no dishwashing except for pots and pans. DEP said that,
unfortunately, there is no exception. I suggested that Dino go to DEP to talk to
them in an effort to resolve this."
Mr. Doherty stated, "I would like to support him in any way that we can. He's
always been a good neighbor in Mashpee and very conscientious."
The Board decided to respond to the Town Administrator with facts and figures
regarding Finally Dino's.
Tribal Council Request
Mr. McQuaid stated, "The Mashpee Wampanoag Indian Tribal Council is
requesting to purchase a residential transfer station sticker for the trash at the
council. They can't buy one for $55.00. They are going to have to have one of
