Article 66 (continued) <br /> space , of the three methods described in <br /> Subsection 9 . 334 above , shall be included in <br /> his application to the Planning Board for <br /> a Special Permit to deveiop an OSID, along <br /> with the required maps and plans describing <br /> the open space areas and the proposed uses <br /> within said areas . Before final approval <br /> of the OSID, or of any definitive subdivision of <br /> land within the OSID by the Planning Board , the <br /> developer shall also file with the Board a <br /> copy of the covenants and restrictions <br /> necessary to secure the permanent legal <br /> existence of the common open space and a <br /> copy of any proposed deed for transfer in fee <br /> to the Town or to a non-profit organization . <br /> Approval of the OSID shall require approval <br /> by the Planning Board of said covenants and <br /> restrictions after consultation with the <br /> Town Attorney. <br /> 9.336 In the event that the organization <br /> established to own and maintain the open <br /> space , or any successor organization , <br /> shall at any time after establishment of <br /> the development fail to maintain the open <br /> space in reasonable order and condition in <br /> accordance wi th the approved plan of the <br /> development , the Town of Mashpee will serve <br /> written notice upon such organization , or <br /> upon the residents of the development , <br /> setting forth the manner in which the <br /> organization has fai led to maintain the open <br /> space in reasonable condition , demanding <br /> that such deficiencies a+ maintenance be <br /> cured within thirty ( 30) days thereof , and <br /> stating the date and place of a public <br /> hearing thereon to be held, after fourteen <br /> 14) days of publ i c not i ce , by the Board <br /> a+ Se l ec tmen . r;t such hear i ng the Board <br /> may mod +-/ the terms of the or i gi n.al <br /> notice as to the deri'ciencies based .on any <br /> ne!:a informa.t. ion or rri.aintenance activities <br /> undertaken b:y the organization since service <br /> of the notice , or ma;/ give an extension of <br /> the time !xi i thin which the:;` shall be cured. <br /> If the deficiencies set forte in the original <br /> notice or in the mod i f i ca.t i on s thereof are <br /> riot cured i.,-)i thin said thirt .'
