Article 66 (continued) <br /> nuisance , may enter upon said open space and <br /> maintain the same for a period of one < 0 <br /> year . Said entry and maintenance shall not <br /> vest in the public any rights to use the <br /> open space except when the same is <br /> voluntarily dedicated to the public by the <br /> owner. . Before the expiration of said year , <br /> the Town of Mashpee shall upon its initiative <br /> or upon the request of the organization <br /> theretofore responsible for the maintenance <br /> of the open space , call a public hearing upon <br /> notice to such organization , or to the <br /> residents of the development , to be held by <br /> the Town of Mashpee Board of Selectmen , at <br /> which hearing such organization or the <br /> residents of the development shall show <br /> cause why such maintenance by the Town of <br /> Mashpee shall not , at the election of the <br /> Town of Mashpee , continue for a succeeding <br /> year . If the Board of Selectmen determines <br /> that such organization is ready and able <br /> to maintain said open space in reasonable <br /> condition , the Town of Mashpee shall cease <br /> to maintain said open space at the end of <br /> said year . If the Board of determines that such <br /> organization is not ready and able to maintain said <br /> open space in reasonable condition , the Town of <br /> Mashpee may, in its discretion, continue to maintain <br /> said open space during the next succeeding <br /> year and subject to a simi 1 ar hearing and <br /> determination , in each year thereafter . <br /> The decision or" the Board of Selectmen in .any <br /> such case shall constitute a final <br /> administrative decision subject to review <br /> in accordance with any applicable statute <br /> of the Commonwealth of Massachusetts. <br /> The cost of such maintenance by the Town of <br /> mashpee shall be assessed pro rata against <br /> the properties within the development <br /> Vat have a right of enjoyment of the <br /> open space ant such assessment shall become <br /> a lien can said properties .
