" <br /> Indefinitely 7./�g Submitted by Town Planner <br /> I <br /> Y postpca�L <br /> ARTICLE 69 . <br /> To see if the Town will vote to amend the Mashpee Zoning By-Laws <br /> by adding thereto the following new Section 11C and by amending <br /> the zoning map to show the ACEC area in conformity with a map <br /> dated November 26, 1979 and entitled "Waquoit Bay Areas of Citical <br /> Environmental Concern" which is on file in the Town Clerk's office, <br /> or take any other action relative thereto. <br /> 11C AREAS OF CRITICAL ENVIRONMENTAL CONCERN (ACEC) <br /> 1. PURPOSE The purpose of this section is the protection of Areas <br /> of Critical Environmental Concegn, areas of ' signi.ficance for <br /> flood control or the prevention of storm damage, waters containing <br /> shellfish and fisheries , and other publ.ic interests identified <br /> by the "Wetlands Protection Act" (M.G.L. ,. Chapter 131 , Sections 40 <br /> and 40A and the Town 's Wetland Protection By-Laws . <br /> 2. GEOGRAPHICAL APPICABILITY This section shall apply to all areas <br /> within ttie Waquoit Bay Areas of Critical Environmental Concern <br /> (ACEC) as designated by the Massachusetts Executive Office of <br /> Environmental. Affairs on November 26, 1979 in accordance with M..G.L . , <br /> Chapter 21A, Section 2 (7) and to a buffer zone extending fifty (50) <br /> feet landward from the edge of the ACEC . For those lots or land <br /> parcels totally encompassed by the ACEC, this article ' s applica- <br /> bility will be limited to one hundred (100) feet landward of the <br /> edge of wetlands as defined by M.G.L. , Chapter 131, Section 40. <br /> In case of any dispute regarding the boundary of the areas de- <br /> fined under this section, the Conservation Commission shall make <br /> the final determination based on the best available data. <br /> 3 . REGULATION OF CONSTRUCTION AND LAND ALTERATION. <br /> (A) Within the above-described area , no construction of dwellings <br /> or any other primary or accessory buildings or structures , exce_ot <br /> those permitted under Section 6 . 3 .I (9) or Section 11C . 3 . (D) , is <br /> permitted. <br /> (B) Within the above-described area, no clear cutting of existing <br /> vegetation or wildlife habitat, except for a path no more than <br /> twenty (20 ) feet wide to provide access to structures allowed <br /> under. Section 6. 3 . I (9 ) . or for trail or .other passive recreation <br /> uses operated by the town, state or other public agency, is per- <br /> mitted. <br /> (C) No dumping, fill, paving, removing of material or dredging <br /> may be done, except as permitted under the requirements M.G.L. , <br />
