Hand count. .161 yee..51 no Motion carries. <br /> Article 71. <br /> To see if the Town will vote to enact the following by-law: <br /> Except as provided for by a specific Act of Congress of the Legislature <br /> of the Commonwealth of Massachusetts, no person, carporations, partnership <br /> or other similar non-governmental :entity shall knowlingly or intentionally <br /> take part in the design, testing, production, deployment or storage of <br /> nuclear weapons. .Research supporting the development,. deployment, transport <br /> and delivery systems of nuclear weapons shall also be prohibited. <br /> EXCLUSIONS: Nothing in this By-law shall be construed to prohibit or <br /> regulate the following: <br /> 1) The research and application of nuclear medicine <br /> 2) Uses of fissionable materials for basic research, smoke detectors, <br /> light-emitting watches and clocks, and other applications the primary <br /> purpose of which is NOT to work towards the development of nuclear <br /> weapons. <br /> 3) All research NOT involved in the desing, manufacture, or deployment of <br /> nuclear weapons or the transportation and delivery systems thereof. <br /> 4) The publication for the benefit of the public or for the scientific <br /> community of the results of pure research in mathematics, physics, or <br /> any other scientific endeavor. <br /> DEFINITIONS: Nuclear weapon is defined to include the means of propelling, <br /> guiding or triggering the weapon, as well as any device, radioactive or <br /> non-radioactive material the primary function of which is to contribute <br /> to the operation of a neclear weapon. <br /> SEVERABIL.ITY: If any part of this By-law shall be held invalid or <br /> unconstitutuional, it shall not affect any other part, and to this extent <br /> the, provisions of this law shall be severable. <br /> Any violation of this By-law shall be punishable to the extent allowed for <br /> such violation under the laws of the Commonwealth of Massachusetts. <br /> Indefiait4ly postponed <br />
