o Requesting variance to install a regular 1500-gallon tank instead of IA system
o Property not on current sewer connection plans
Property Location & Regulations
o Located within 1000 feet of the waterway, triggering IA system requirement
o Specifically, the property is within 60 feet of John's Pond
o Board members uncomfortable granting variance due to proximity to water
o Concern about setting a precedent for future variance requests
Motion & Vote
o Motion made by Mr. Livingston to Deny the variance request. Mr. Raposa
seconded the motion.
o Roll Call: Mr. Livingston (Yes), Mr. Raposa (Yes), Mr. Virgilio (Yes)
o Motion passes unanimously

Documents provided: Public Hearing/Variance Request Form (2 pgs.)

 51 Evergreen Circle, William Russell – Variance from the Flow Neutral Bylaw
o Mr. Virgilio is recused.
o Meeting to review three variances for a commercial facility development
o William Russell introducing the project, approximately 30,000 sq ft
o Project undergoing Cape Cod Commission review, with conditional approval
expected
o Three variances requested:
1. Use of operating plan for bio-barrier solution (10 mg/L IA system)
 A variance has been requested to waive the installation of a
groundwater monitoring well, typically required under Section 5.0
of the Town of Mashpee Regulation to Protect Water Quality. This
regulation mandates that new systems achieve no greater than 10
mg/l total nitrogen in the effluent and be tested quarterly via a
monitoring well. The proposed project plans to use a BioMicrobics
BioBarrier MBR system, approved under MassDEP's Title 5,
which is designed to reduce total nitrogen to less than or equal to
19 mg/l for systems with flows below 10,000 GPD. A site-specific
design letter from BioMicrobics indicates that the system will meet
the 10 mg/l total nitrogen requirement. The performance testing
and monitoring plan required by MassDEP will ensure compliance,
thereby achieving the same level of environmental protection
without the need for a groundwater monitoring well.
2. Reserving space for the second leach field without installation
 A variance has been requested in Mashpee to construct only the
primary leaching area for commercial septic systems, omitting the
reserve leaching area and associated valve, which Section 6.4
usually mandates. The proposed system uses a pressure
distribution method with alternating pumps to manage a flow of
2,000 gallons per day, thereby meeting the requirement for the
alternate use of leaching facilities without needing the reserve area
or valve.
2
