The Chair reads Commissioner Cook’s letter into the record. The letter outlines the <br />concerns regarding the Regulation 25 Draft, which were raised by the Popponesset Beach <br />Association (PBA), along with their feedback on each performance standard. <br />Additionally, Commissioner Cook provides his feedback on each performance standard. <br /> <br />PBA FEEDBACK <br /> <br /> Regulation 25: Waiting for state changes to align with both regulations. Concerned that <br />the new Mashpee regulation will be too burdensome and not consistent with the other <br />towns in the state. <br /> Agree on immediate changes pertaining to setbacks and foundations. <br /> External Review: Hired an outside firm to review the proposed changes and provide <br />recommendations. <br /> Consultant Request: Askes the Commission to hire an external consultant for review <br />before public comments. <br /> Floodzone Standards: Seeking further clarification on which standards apply to which <br />floodzone area. <br /> <br />PBA PERFORMANCE STANDARDS FEEDBACK <br /> <br /> How is adverse impact defined? <br /> The standard doesn’t cover additions to existing homes. Sheds, patios, fences, <br />and retaining walls fall under different regulations. Patios and fences are <br />considered landscape features, while retaining walls may be necessary for <br />septic systems or existing topography. As for garages, the standard doesn’t <br />specify whether they are detached or attached. Lastly, “other appurtenances” <br />refer to additional structures related to the property, but further clarification is <br />needed. <br /> No issues <br /> No issues <br /> No issues <br /> There is a need for a clearer definition of which A zone this applies to, and it <br />should also impact V zones. Currently, it doesn’t align with the current FEMA <br />flood zone elevations. <br /> Remove the 150-foot buffer note. PBA was opposed to the proposed <br />performance standard prohibiting vertical walls in the A Zone within 150 ft of <br />a coastal waterbody. The commission considers house foundations to be a <br />type of vertical wall, thus this standard may conflict with building code in the <br />flood zone <br /> A: Clarification is needed on the existing roads in flood zones that need to be <br />maintained and repaired in their current state unless there are mitigating <br />2 <br /> <br /> <br />
