It is proposed to add a new performance standard: If a homeowner achieves <br />nitrogen-neutral or nitrogen-negative results, they can apply for a waiver at the <br />Commission's discretion. This would expand options for homeowners and pave the way <br />for future innovations, significantly enhancing flood zone management. <br /> <br />AGENT FEEDBACK <br /> <br />The main issue is the 150-foot buffer zone to land subject to coastal storm flow, <br />compounded by the lack of staff and enforcement. The hesitation to endorse the 150-foot <br />buffer zone stems from the absence of standards for Flood Zone X. Agent stated there are <br />no existing standards for a buffer zone of jurisdiction to the 100-year floodplain. There is <br />no buffer zone of jurisdiction to the 100-year floodplain under DEP's existing 100-year <br />regulation, nor is there a proposed buffer zone to the 100-year floodplain in the current <br />draft of DEP performance standards for Land Subject to Coastal Storm Flowage. <br />Enforcing jurisdiction without clear standards is impractical. Including a 150 ft buffer <br />zone to the flood zone without any known performance standards and limited staff to <br />provide enforcement will not be feasible. <br /> <br />PUBLIC COMMENT <br /> <br />Mr. Malloy of the Popponesset Beach Association provides feedback on the <br />Regulation 25 draft and requests a workshop with the Commission to discuss concerns <br />about the proposed changes. <br /> <br /> DEP onsite appointment for Superseding Order of Conditions at 84 Punkhorn Point <br />(agent update): <br /> <br />The Agent met onsite with the property owner, representative, DEP reviewer and <br />abutter Mathew Haney, who owns the adjacent salt marsh. Haney expressed concerns <br />about the accuracy of the salt marsh delineations and potential flood impacts from <br />approved activities. However, his concerns were not professionally vetted, as he is not a <br />wetland scientist and offered no expert testimony. The applicant had removed a proposed <br />putting green, and Cape and Islands representatives maintained that the project met <br />performance standards. The DEP's superseding decision is awaited, with no set <br />timeframe. <br /> <br /> John Austin Forest Trail <br /> <br />John Clark and Tara Galvin of 25 Oyster Way met with the Commission to <br />express their objection to the trail expansion. They believe a trail leading from their <br />property to the main Mashpee Woodlands trail was deliberately blocked with deadwood <br />in retaliation for their objections.
