4 <br /> Board of Selectmen <br /> Minutes <br /> September 25,2006 <br /> "Hearing.--Cafd de la Terre--License Violation: <br /> Selectman Cook stepped down for the above referenced Hearing. <br /> The Hearing notice was read aloud concerning the license violations at <br /> Cafe de la Terre. On September 7,2006, the Town Manager met with the <br /> Manager of the establishment to review matters regarding the enclosure of <br /> outside dining area as per the direction of the Board of Selectmen. It was <br /> determined that no changes were made to delineate the outside dining <br /> patio. A seven-day extension was granted. On September 15, 2006 an <br /> inspection was conducted. The outside dining area was deemed not in <br /> compliance with the Selectmen's directive to delineate and enclose the <br /> outside seating area to identify the restrictions of the license premise. <br /> Michael Donaldson and Jessica Donaldson,Manager(s)of the Cafe de la <br /> Terre met before the Board to explain the lack of compliance and <br /> miscommunication regarding the barrier placement. It was disclosed that <br /> Michael Donaldson is not managing the business at this time. Jessica <br /> Donaldson indicated that she has ordered the divided barrier parts online <br /> and they are expected to arrive by the end of the week. Chains and stakes <br /> • are presently in place to temporarily delineate the outside seating area. <br /> The Donaldson's apologized for the miscommunication. To conform to <br /> legal requirements,Mr. Donaldson was requested to remit correspondence <br /> to the Selectmen regarding the establishment's change of manager status. <br /> A vote of the Board is necessary, but it does not require a public hearing. <br /> Motion made by Selectman Green to request the Town Manager or <br /> Selectman designee to verify and inspect the presence of a temporary <br /> outside seating barrier at the Cafe de la Terre that would conform to <br /> the Selectmen's request and allow the business to operate the outside <br /> dining area. <br /> Motion seconded by Selectman Cahalane. <br /> VOTE: Unanimous. 4-0. <br /> Selectman Cook absent. <br />
