MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 12, 2025 <br /> Discussion <br /> Attorney Christopher Kirrane mentioned that what is proposed is keeping with the <br /> spirt of providing additional screening. He is opposed to Mr. Clapper's comment that <br /> his client has not been in contact with him. His client has sent several emails over <br /> the last few weeks. Also, under Section 174-24 (C) (9) of the Zoning Bylaws does <br /> allow for a modification in front of the Zoning Board who are the Special Permit <br /> granting authority. <br /> Mr. Reidy read the Conservation and Board of Health comments into the record. <br /> Mr. Reidy made a motion that the Board issue a modification for 68 Mercantile Way <br /> with the following conditions. <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Modification to the Special Permit under Mass General Law 40A Section 9. <br /> 2. Site Plan - Additional parking Layout Plan, Project Title: Contractor Bays, 68 <br /> Mercantile Way, Mashpee, MA. Prepared for: Daniel Hostetter, Prepared by: <br /> Baxter Nye Engineering & Surveying. Stamped and signed by: Matt Eddy, No.: <br /> 43183. <br /> 3. Conditioned on all Town Department comments read into the record including <br /> but not limited to the Board of Health and Conservation Department comments. <br /> 4. Conditioned that a final as-built plan be submitted back in front of this Board, <br /> and that the applicant install an 8 ft. fence around the dumpster. <br /> 5. Any changes to the plans will require the applicant to return to this Board. <br /> 6. The Board finds that the Modification to the existing Special Permit SP-2022- <br /> 29 under §174-24 (C) (9) (b) 8v (c) as submitted is not substantially more <br /> detrimental to the neighborhood. <br /> Discussion <br /> Mr. Morris asked that a condition be made that the final as-built plan be submitted <br /> for final approval in front of this Board. <br /> 11 <br />
