MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 12, 2025 <br /> Mr. and Mrs. Clapper, at 10 Sugar Pine Circle. Ms. Clapper spoke first stating that <br /> she is opposed to the modification of condition number #6 of the Special Permit. She <br /> said it's just a"band-aid" to the already existing issues with buffering out the sound <br /> and light that they are dealing with, and as each individual units are sold, who will <br /> be operating in those units, and what will be their own ideas. They have been unable <br /> to get consistent enforcement of these agreements. She said the eight-foot buffer is <br /> the only stable and permanent attempt at truly buffering their home from this <br /> development. She continued to mention that the lights, sounds, and vehicles are an <br /> infringement on their quality of life and ability to enjoy their backyard. <br /> Mr. Clapper thanked the Board for their service to the Community. He stated that <br /> he appealed the Building Commissioner's Decision to the Board, and the Board <br /> agreed to their request that it was the Building Commissioner's responsibility to <br /> notify the developer that the landscape was not done properly and they needed to <br /> correct their mistake. He also requested that an 8 ft. fence be installed around the <br /> dumpster instead of a 6 ft. fence. He has no issues with the eight (8) additional <br /> parking spaces. He does not agree that the modification is allowed under the bylaw <br /> section 174-24 (C) (9) (b) and (c). <br /> Mr. Milbury asked Mr. Morris to explain his opinion of the trees. He said that the <br /> site was installed professionally, and that if the trees are planted too close to each <br /> other they will not survive. <br /> Mr. Roger Brooks, with Cape Wide Construction addressed the Board and said that <br /> the agreement back in 2022 stated that the trees would be planted 8 ft. on center, <br /> but they were actually planted 10 - 12 ft. on center because these trees have some <br /> growing to do. As a gesture of goodwill, he and his partner are willing to include <br /> additional buffering for the neighbors, and if they want them installed in some other <br /> location, he can work with them. <br /> Mr. Goldstein asked the Clappers if they noticed the trees planted at the Franey site. <br /> Ms. Clapper didn't notice. <br /> Mr. Morris made a comment that he wants to end this discussion, and will not be <br /> the final "judge and jury" of what is agreed upon, and any approval should be a final <br /> decision of this Board. <br /> Charlie made a motion to close the public hearing.
